Hi,
My I-140 is recently approved and my lawyers refused to provide me a copy of the approval. Is this common practice?

What happens if they unable to process before September 08 visa bulliten, and in god forbidden, if the dates doesn't progress in Sep Visabulliten?

I advice you all to walk in to ASC locations.
I went to one ASC location as walk in. They asked me to go District office where I already tried with an Infopass appointment.
Then I tried at another ASC office, and pleaded them saying my dates are current, take my FP, then I can get my GC. That officer is nice, he took our FP and they were cleared and sent to USCIS yesterday.
I will say, try in at least 2 ASCs at least twice at each ASC. Infopass is waste.
I went in the morning around 8.30 and there were only 4 people for FP and that officer took our FP after 40 min phone / PC communication.

The original offer should be valid at the time of filing 485. If it is not your 485 can be rejected.
Now USCIS may never ask you that question, their common RFE is current EVL, and the 485 may still get approved.
whether it is possible to an employer to revoke the offer he made for permanent Job while submitting the 485 petition.

I spoke to Carol (Badge #Ex547) at Nebraska service center just now. She told me that it take 60 to 90 days before they take my case and it's not yet assigned to an officer. She also told me that you are one among those 500,000 other applicant who applied in that time frame. So, though the Aug,2008 is current for EB2 and RD is under current processing dates, there are lot of application which won't get GCs until another 4 or 5 months (by the time they assign cases to officers etc takes minimum 2 to 3 months even our RD is under current processing dates with Nebraska and PD is current)

Not to criticize you, but every year there are thousands of students coming from India to the US. Although their numbers have dropped slightly for the first time in 2006, they are still enormous (60K+ every yr). Getting a GC in 6 months even after Skil is passed does not seem likely. When the bill will pass, it will reduce hardships not eliminate them.
The number of students who come here is not controlled by the number of GCs, unlike that of people who come here on H1B.
There are many reasons for this unprecedented rise in the number of students coming from India in the last 5 years. Undergrad enrollment has been falling in many engineering departments. Hence grad admission standards have been relaxed, and international students are being welcomed. Plus, in the post-cold-war era, the US consulate does not deny visas the way it used to in the nineties. If you did not have financial aid from a univ then, it was difficult to get a visa. Also, kids in India these days get $10K loans from banks! So coming here is no longer difficult. So as I see it from a univ setting, the number of Indians applying for GCs will continue to be very high for the foreseeable future (10 yrs?). But hopefully, those with PDs until 2006 should see their GCs in 2-3 yrs after the bill is passed. We can't worry about all of the people who are coming now....

In that case all visitors will get cheaper medical treatment just visiting America.
Govt is not the answer to all probs, although its the only in terms of GC though.

I hope you are all doing great, well settled, happy that you got the receipt notice and EAD and can change jobs. The July USCIS/DOS drama and IV/AILA/Lofgren fight back was an event that is unforgettable, especially based on the fact that these events have changed a lot of our lives.
I have been with IV for more than an year now and have followed the organization's direction and views. I found this to be a very nobel organization, an organization where seeds are sown for betterment of lives.
My biggest thanks to members who have done selfless help. Amazing people. Excellent qualities. Team spirit. We worked as teams for various action items, became very good friends, had our own fun when we interacted.
Time has come for the entire community to stand up and act. IV, as an organization, is well respected in the DC circles. IV has maintained its "Non commercial" stance and has believed in grass roots efforts.
IV is nothing but people like you and me. Believe in yourself. Have faith in yourself. History has proven that bravery, courage and faith have been the weapons behind success. Yes, we can move mountains - we have it in us. We can do things, only if we believe in ourselves.
I work as a contractor in a small company in New Jersey. I was a bit reluctant initially to ask my client for a day off - as I had already taken 15 days off in August. But I gathered enough courage and talked about the rally to my boss and offered that I will make up the hours. My boss is a Korean immigrant, immediately acknowledged and said "It's fine, I am supportive of your cause - I see that you have been here for 8 years now and still fighting the system that does not look fair".
I am happy that I spoke the truth, I am happy that my boss has agreed wholeheartedly to my request. I have believed in myself all along.
My dear friends - America does not see tears, America is a land of the brave - America has been a favorite destination to all. The very fact that there are 300K July petitions - is an example on how much people still want to be here. And if you all believe that so many petitions will be processed without making any effort from our side, or if you think someone else will do it or if you pray God that and assume God will take care, then I would only say "God bless you".
If we all step up for our basic rights of processing our petitions in a timely and orderly manner - then yes we can see changes - always remember, it is people like you and me that will influence a change. Unless we stand up together and ask - nothing is goin g to happen. America has honored people who have stood for themselves - America has produced great leaders, all these people have stood up for themselves.

In 2009 let us assume 8000 485's will be filed till november 2009
On an average 13000 EB2's are being issued per year. I don't have the exact source but I read that 5000 EB1 are issued for India and this may reduce to 4000 because I think universities are also having a crunch in grants, research and phd's being issued.
So total 485's pending till nov 2009 = 13,125 + 9700 + 8000 = 30825 (approx)
Total = 30825 / 13000 = 2.37 years
So by sept 2012 you can expect it to be current unless there is massive porting from eb3 to eb2. sept 2013 would be the worst case sceneario where you would expect it to be current.

I did call my lawyer and she told me to wait for 2 weeks. Finally she told me the RFE regarding marriage, birth certificate of my wife and birth certificate of my daughter. I did send all info to the lawyer in June 2007 and she may missed to send or USCIS missed it.
Any way she want $500 each to reply the RFE, a total $1000. What the lawyer will do?, just send my papers and may send with a cover letter.
I did call the lawyer office and told them to send the original RFE to me. The legal assistant says no. Then I told her to fax the copy to me so that I can arrange the documents. She send me the fax. I did collect all the documents and made a cover letter by myself and made a neat arrangement of all papers with tags and send to Nebraska (included the RFE copy on top).
I saw LUD after 3 days and GC aproved within 10 days. After 1 month lawyer asked me money and papers. I told her we already got GC.
So moral of the story is not too much depend on lawyers. You may need if there is an interview. Otherwise a waste. If your case is straight forward, don't worry. You can change the lawyer and make representation by yourself. When the PD is current GC will come automatic. Lawyers have no role in that. They didn't check your case every day. You need to look.

We legal folks just have to carry an extra document, doesnt hurt us in the long run.

Not received any FP notice on my I-485 yet and talked to an IO last week using POJ method and the lady told me that I should received FP within a month.
There is no update in the online status check which I guess means that they have yet not sent out my FP.
Should I call again about this case?

You might be right, nothing might come out of the lawsuit, but atleast you have to try. AILF has clearly said they will not charge any money for the lawsuit. When somebody is willing to fight a battle for you, if you dont want to join thats your wish but why discourage others who want to do something about the 485 fisaco.
My guess is it's all fuss to gain the publicity. for all who are hoping to see something good out of it : dont expect anything. It's just matter of time before you see your 485 file returned to you. Then everything will be cool and calm. You will be out of shock and start looking for next visa bulletin in mid-Sectember. Lawyers are giving you hopes and that's their job and just like what AILF is doing. The case will be stretched for long and USCIS/DOS will get a slap in the wrist. Thanks Copsmart! So you are saying that currently my wife is on H-1b status even though she did not actually worked for that company yet. I wish they considered her as being on H-4 status. BTW, while applying for EAD, what should I put in for question 15 (current immigration status) on form I-765? In her initial EAD that got approved in October'08, she had this answered as H4 - Dependent. Do I have to put in H-1 there or can I put in H-4 or AOS instead? Thank you!
