I had both a valid visa stamped on my passport and AP. But my wife did not have a stamped visa so I showed her AP and my h1. The immigration inspector said that you both have to use AP to enter. I argued with him a little that I can use my h1 when it is valid but he did not agree and said that I am trying to do a fraud. Well I did not argue much and let him stamp my I 94 with a parole stamp till 01/26/2007. I have now filed for my extension.
I have verified that with my attorney. The officer should not have asked you to enter on AP. You could have entered on H1 or AP and it was up to you. This is a good example of the fact that some immigration officers do not know the rules well. If your H1 is still good, you can leave and re-enter showing H1 and you should be fine.

Teddy, any update to predictions based on the current status of availablity of EB1 ?
Krish I believe that Feb - Apr 2007 is very realistic now although we don't have all the details of the news yet. 12K numbers if applied in May will lead to 4-5 months of movement not just a wekl. I do echo VDLRAO's wish there is a good chance that we maybe near the Jul-Aug 2007 line however we should wait for the May bulletin to assess that.

I had already mentioned my EAD status when they had the interview. But after acceptiing it I mentioned it again in the conext of I9 form. Then they said they cant offer me emp;oyment due to my being on EAD.
This is a pretty big company. I understand that H1B is not protected under anti-discrimination for employment, but EAD holders, specifically those with AOS pending, are a protected against employment discrimination.
Does anyone have any links to the above conclusion ? I am so tired of this BS. I have spent long enough in this immigration c**p that if I have leave, might as well leave with a fight.

One more thing.
If you decide to apply multiple 485s with each other as dependents, then file just one first. Wait. Gets its A number and put that number in the other application. This way you will cover one pitfall of multiple filing. It will not cause confusion at USCIS end.
one thing to consider though: with the number of 485 filings that are expected in July, receipts are probably going to take 8 weeks or longer to come through (just ask teh H1B filers this year). By then the PD for the other spouse would have probably retrogressed. Another thing to keep in mind...

Guys do not feed the freeloaders by telling anything you are reading in the donor forum. Let these people help themselves by signing up for recurring contributions if they want helpful nformation about their EB2 PD movemement. We are still not meeting of our advocacy day amount. The OP could try contacting the manager of the HR regarding the EAD thing before getting lawyered up. Clearly the policy, doubt there is one, violates whats stated on I-9. You are not asking CapitolOne for any sponsoring of GC. What if you are a derivative holding an EAD? Did they know that when they decided to quote this "policy" of theirs? Doubtful.

I have tried enough on every forum including this (even whe we need a genuine information and not just predictions).
No one to be blamed! But relax, there will be a time for CP guys too!
Maybe people are not responding on the basis that they do not have any knowledge of consular processing.
I think majority of people on this forum are in the US and are adjusting status. Surely you would not want answers that were wrong or misleading.

I don't know what do you mean by success. as far as media coverage is concerned, Fireign media (India, China or elsewhere) doesn't help. It's local media, which can create some usefull awareness. This is a real problem. I got a letter from a prospective employer, who wanted proof that I was legally eligible to work in the US (alongwith transcripts, previous employment letters etc.) prior to scheduling an interview.:cool:
I believe employers are seeing a lot of candidates on EAD, and for whatever reasons they dont think EAD is good enough and would like to weed those candidates out beforehand.
We need to fight back against this discrimination.:mad:

I need some help with my situation:
After 5 years of waiting, my Labor got finally aproved thru Dallas BEC(EB3, RIR, PD: Oct'02). But my wife is in India on vacation and as per original plan will return middle of August.
1. What are my options so I can take advantage of the PD being current for me?
2. can I apply for I-140 and I-485 and then apply her I-485 when she returns?

As per my knowledge, ask your wife to come back from India and file I-485 along with your petition by before Jun 30, 2007.
If you want to wait till she comes back from India you can, but at that time (in Aug ) Cutt-off dates should be current to your PD date, If not you CANNOT file I-485 to your wife.
