One more thing to not miss it to request "dumping of the 50,000 diversity visas done by lottery". Why the hell should that many visas be thrown away like the way its done now. If looked thru the lens, this category makes no sense atall.

I was amazed to hear about the development. Would Mr. Gonzalez will show a curtsey to personally reply to all the people who sent flowers, and apolozise for the pain and emotional trauma his agency has caused to thousands of legal immigrants in this country ?
BTW, couple of years ago one of my American (citizen) friend was dealing with USCIS (at that time INS) to adopt a baby from China. When she got the baby after struggling for 4-5 years and with a push from local congressman, she was agahst with the way USCIS treated her. I still remember her remarks "If they do not understand the pain and suffering of a mother, and they do not care for a suffering orphan child, I highly doubt that they have any more humanity left in them".
The name has changed but the public face of the agency remains the same. Please remember that for them we are not human's, we are just file numbers sitting and rotting at their service center's.
So when USCIS decided to forward the flowers to our soilders (which we think is an excellent idea), its not because the agency has a human touch in it, but its because they found an excellent face saving mask for their unjust action.

Yes you can -when you were eligible for the EB2 filing at the time of filing for EB3!
Why would someone do that u ask? Please call my employer and ask him this question. The answer is - so that you are stuck with him for few more years.

Anyone in my situation? Thanks again.
Travelling via London Gatwick and Dubai to India and back. No airport change required during transit. Using AP, visa expired. I have a valid Canada PR card.
According to UK embassy US GC and Canada PR card holders do not need transit for direct airside transit. Does anyone have any experience in this situation? Please post.

If EB2 row perm hits 10000 apps thats it pd wont move a bit. That will happen as soon as hiring starts again. This will happen any time, if this not happen until sep 2010, then EB2 has a chance. There are about 15000 (approx) EB2 Row apps siiting ducks in Perm centers, if ROW PErm eb2 approvals start flowing then we are just stuck. It all depends on EB2 Row Now. That is the one we need to watch closely.
Even if the economy improves, it will take some time to plan the recruitment, then hiring people and then they will take sometime to start the PERM process and then filing it and getting the approval. FOr all these things to happen, it will be a minimum of one year ad even it may cross two years. Don't bother too much about this.
I prefer the economy to improve over getting GC, if economy is good we will not have to worry about getting a Job if laid off and also, if we have EAD we can change jobs easily and many of the problems without the GC are not that siginificant then.

I don't get how you are getting the 8008 figure. Based on the 9%, you are right about the cap for any country being 12,600 for all EB categories combined.
Pre-adjudication has nothing to do with country quota. And 'assigning a number' is still based on country quota. With all the pre-adjudication, it is likely that 'assigned numbers' = GC approvals. The 'assigned numbers' concept was a lot more relevant till last year, when they had numbers, but still had to 'process' the applications. Now most applications seem to have been 'pre-processed'(pre-adjudicated)

Great to hear your wife's approval and hope she is doing fine now, after the emergency.
Appreciate your helpful attitude towards others who are struggling with USCIS process.
After the infopass for me and my wife, we had multiple soft/hard luds and status changed to case moved to local office.
Received mail that we would be called for interview.
Wish they get this fast when the dates are current.

My wife and I both have filed forms N400 in October of 2006 in Minnesota (Nebraska Processing Center). USCIS received our applications on October 10th, 2006. On October 18th both of us received the fingerprints requests, which have been processed on October 27th. My wife’s case has been approved in February of 2007. She had her citizenship interview on March 16th, 2007 and became the US citizen on April 11th, 2007 after taking the Auth of Allegiance.
I have not heard anything about my case since the fingerprints appointment. I have tried calling the USCIS Customer Service Number but they did not have any updated information about my case. I have also spoken with the Immigration Officer in the local USCIS office (InfoPass appointment) on July 27th, 2007. I have learned during that interview that my case is pending due to the FBI Name Check. The estimate that has been given to me was as long as 3 to 5 years, maybe more.
So as of now my application is pending together with 320,000 others. Well since it's been pending for almost a year now I'm a proud member of 152,000 who had been waiting for more than six months, slowly moving to join more than 61,000 lucky ones that had been waiting for more than two years. Hence my next question.
4. Did anyone hear the Name Check clearing between one year and two? Based on all of the people I've talked to it either took just a few months or more then 2 years. Seems to me once they put your file in that special pile it will not take less than 2 years.

As such, you have to start looking for other jobs because you are not sure if they will accept EAD even after a week.
If they offer you the job, well and good, but if not, I think you can litigate for various reasons because what they did is not right.
I am going to start as soon as I calm down :)
