"Anti-Discrimination Notice. It is illegal to discriminate against any individual (other than an alien not authorized to work in the U.S.) in hiring, discharging, or recruiting or referring for a fee because of that individual's national origin or citizenship status. It is illegal to discriminate against work eligible individuals. Employers CANNOT specify which document(s) they will accept from an employee. The refusal to hire an individual because the documents presented have a future expiration date may also constitute illegal discrimination."
Yes, This comes into picture once company decides to hire. Now hiring is teh last process and beofre that you get grilled in multiple interviews. Employer is tsill at liberty not to interview EAD holder. If you are not interviewed, hiring would not come into picture and hence this text of law in I-9 form is worthless for you for that position. Communist/progressive leaning organizations such as ASHA and AID are fighting, doing activism, struggling and all doing all that, with a subconscious unhealthy feverishness in the mind. The long term result of their noble goals tends not to promote peace but a latent violence (does not have to be manifest violence).
It is possible to bring justice with inner peace but at the same time steadfast determination.
I am writing not directing to SOP who I wish only the best, but to bring about these subtle points.

My 140 and 485s (with my wife as derivative )are from Nebraska and have a set of A#s,

OH law website says that the bill will be introduced around 10.15 today morning.

Looks like this year USCIS understood they need some money and accept some extra applications, which may be the same file I485 when PD is not current. and date might go to end of 2007.
Just a thought

Good news for your guys. I am EB3 but recently my labor got approved in EB2 and very soon I am going to port PD from old labor. :DHa..:Dha..:Dha..You can�t stop me and very soon I am going to stand in front of you in EB line.
How come you couldn't file in eb2 in the first place? Not a personal statement, but I'm still trying to understand this matter.

It is a oneway call for giving information on, "USCIS Receipting Delay - How Does This Affect You?" Perhaps they are going to repleat what they said on this on Oct 5 (i.e. mention nothing about applications not in the system, other than just to wait). What if USCIS guys mixed up "done" and "yet to be done" boxes. You will perhaps never find un-entered filings, unless someone checks manually each and every filing in each and every box.

My I485 is pending since October of 2006. I had a RFE for medical in april of 2007 and replied quickly. Since then there is no movement in my case. I contacted USCIS several times and they told me that my name check is pending...

Raju Sen Sharma woke up Tuesday with one important errand in mind: He had to order flowers and have them delivered to Washington, D.C.
The 29-year-old man, an Indian immigrant in Orlando, was not marking an anniversary or wooing a sweetheart. The flowers were for Emilio Gonzalez, head of U.S. Citizenship and Immigration Services.
Sen Sharma was sending them as a symbolic reminder of the plight of foreigners like him, who entered the U.S. legally but cannot find a way to remain permanently.
In a recent Indian-made movie, sending flowers to prove a point was the method used by the lead actor, following Mohandas K. Gandhi's teaching of nonviolence.
So hundreds sent roses and daisies to peacefully protest the recent reversal of a decision that would have allowed many to apply for the "green cards" entitling them to permanent residency.
Immigration-agency spokesman Dan Kane said about 200 flower arrangements had arrived at the Washington, D.C., offices by lunchtime Tuesday.
Gonzalez said in a statement that he had those flowers forwarded "to our injured service members" at Walter Reed Army Medical Center and the National Naval Medical Center in Bethesda.
"We have been trying to get the green cards in the legal way, and we have gone through all the process and it hasn't worked for us," said Sen Sharma, an energy-software analyst at the University of Central Florida. "We just want a fair chance."
Other immigrants are joining a class-action lawsuit about the rejection of their petitions, to be filed by the D.C.-based American Immigration Law Foundation and the American Immigration Lawyers Association.
Engineers, programmers, lab technicians and other educated immigrants had scrambled to file paperwork, following a June visa bulletin from the U.S. Department of State that gave them hope visas were still available.
But U.S. Citizenship and Immigration Services issued a terse statement July 2, saying it would reject the status-adjustment applications because it ran out of those visas.
Kane said he could not comment on the mix-up because of the expected lawsuit. The agency has an annual cap of about 140,000 employment-based visas; hundreds of thousands of foreigners compete for them.
"It's very disheartening for people to get their hopes up and spend thousands of dollars in filing paperwork to then be told nothing is going to happen," said Aman Kapoor, president in Tallahassee of Immigration Voice, the group leading the flower campaign.
Catherine Henin-Clark, an Orlando immigration attorney, said the cap leaves thousands of worthy immigrants in the limbo of temporary status.
"When it comes to legal immigration, we are not encouraging the people that we want to have here," Henin-Clark said. "We are turning them away, and that is going to affect the economy one way or another. We have always relied on foreign workers."

I just received my 2 year EAD. Priority date is Nov 2002 - EB3 -India. Well I guess that says it all. If USCIS thinks that Nov 2002 will take at least another 2 years then I dunno what about the rest. I didn't wanna think about EB2 porting being so close and spend another 10k, I guess just need to stop worrying about it now. :)

Congrats ski_dude12. My personal opinion is that this may have delayed your greencard since July. Sometimes people get too anxious once their date is current and want to try everything that is possible to get approval. There is so much information and misinformation on forums.

Today we received our welcome notices. The PD on my application is correct but the PD on my wife's application is same as the receipt date. Is this normal for the dependent application?
Our applications were approved based on substitute labor. Our 485 is based on 140 with PD Aug 2006 but we have another substitute labor with PD Nov 2005. When I applied for 140 with PD Aug 2006, I added my wife as dependent. But in the substitute labor I am not sure if my wife was added.
Is there anything to worry or just ignore it?

Check with your lawyers. It should be easy to get an amended approval notice or atleast a letter from USCIS that it is okay.

I am upto 14 letters signed, sealed and mailed to the President. I am waiting on a few more to come....It took probably an hour over the past week. Guess what...in the process I educated over 20 Americans about our issues. Guys this can have a cascading effect if we talk to people we know and get these letters. We all need to step up and actively talk to all Americans we know and get these letters. They are our support bank when its time for larger fixes and we need Americans to call their Congressman & Senators to help us.
Talk to EVERYONE you know and get a letter signed. It would be great if everyone mentioned the number of letters they have got when they put out posts on this thread. Lets not just talk the talk but WALK the TALK!!!:D

Hello,
I have heard of the TERM 'Interfiling' to port your priority date from EB3
to EB2. This i hear happens when your 485 is pending with USCIS and
you have an EB2 labour with current PD date. So you transfer the PD using Interfiling.
Any one any thoughts or have you done this ?
