Yeah, Yeah, call me a cynic, but it is a win-win situation for them (lawyers)
If you file 485 they get their fees............as simple as that. Your application might or might not get accepted. The lawsuit might or might not be won. But alas your fees are paid.
If they took a stake in the outcome by saying they will only accept the 485 filing fees if the application is accepted then their stand would be more honorable. Until then I take it that they are acting in their own self interest. No more no less.
Do you know that most of the big law firms will send you an invoice if they start your case. Also, most law firms are saying that they will not charge twice. So how does your argument hold now. :rolleyes:

The reason 485 was not filed with 140 was my PD wasn't current at that time.
However, I am worried about the USCIS identifying the problem later on. I am not convinced that at 485 stage they can go back and check the validity of the I-140 approval unless it is a case of a fraud, which is not the case here.
Also, I was thinking that I will let the lawyers know about this after my 485 is filed. After all it is their mistake and not mine. Does this make sense. Thanks!
Get is corrected ASAP. Its a typo while generating the approval notice. Your lawyer should be able to rectify this discrepancy with USCIS over the phone and new approval notice won't take more than a week to arrive.
I know its tempting, to convince yourself otherwise, but you will kick yourself for life if it gets denied later.

The countries who have achieved double digit growth in the past (south east asian countries, china etc) have done it by upholding the human dignity. By focusing single mindedly on numbers and statistics of growth rate, the human element behind it should not be forgotten.

Dont go for consultants. They explain different stories to your parents and your conditions and circumstances are different. We did the whole paper work ourselves. If you want any more information please do not hesitate to ask I will be more than happy to help.
Mainly I focussed on these things for my parents after 2 rejections
1) Why they want to come to USA
2) What are their ties to India
3) Who will sponsor their trip
4) How long they will come
I did prepare a cover letter addressed by my father laying down very clearly what is the purpose of their trip, Social Ties and responsibilities in India, reason for coming back, Financial support for the trip. and also focussing on family in India. Although the visa officer never looked at any of the docs.

Since you have already been issued a H1B - there is no such thing as "next year". Even if you applied during the April 1st madness, your H1B will not be counted against the cap. On the I-129 form there is a question that asks (not sure of exact wording, so don't hold me to it): "In the previous 6 years has the benificiary ever had an approved H1B. If so provide details".
So no matter when you apply for H1B, you will not be counted against the cap. It is possible (and I am not sure of this fact at all) that your H1B clock (6 yr limit) has already started ticking.
In such a situation as yous, it is better to talk to a good immigration lawyer as she/ he can give you better guidance.

One of my friends has filed I-140 and 1-485 (concurrent) in July, 2007 under EB3 with PD Feb 2007. His I-140 was approved in Nov 2008 and his spouse I-485 has been approved on Jan 29, 2009. They are from India

In 2004 my wife's consulting company started her LC process with an agreement that, my wife would pay for all the cost related to LC, directly to employer's attorney. In return she can join her current client without impacting her GC process; consulting company would continue to sponsor her GC. She did join her client with employer's consent at a later date after starting her LC.
Her LC got approved, I think, 3 to 4 months before LC substitution was banned. As long as she was writing checks, attorney office kept her in the loop. All of a sudden attorney office stopped returning her calls and e-mail. This prompted her to contact PBEC, only to find out that her LC was approved. When she contacted consulting company they didn't return her call at all, after talking to her for the first time. I'm sure that LC got sold.
So far my wife has contacted labor department and Sheela Murthy's law office to see if she can file any case or law-suite against the company. The answer we are getting that, from immigration-law standpoint employer can substitute LC legally.
My question is - can we file a case against employer for fraud and cheating? We have saved each and every receipt, checks, emails exchanged. However there is no written agreement between employer and my wife.

You can not file a case against the employer doing LS, but making you pay for labor is illegal in DOL eyes that is the only positive point you got in my eyes. Your wife started working for the client, which is obvious she will not be joining GC sponsoring employer anyway. All you have lost is money (& time ofcourse), and that's the price for two edged sword deals. Consult an experience attorney and see if anyone can do what you are looking for.
