...but I would rather retire early with enough money to do what I want in India (or any other country of the world) in the sunset of my life. For that GC is an absolute necessity. Thanks for the nice ad, but I was already hooked about attending that rally even before I could visualize my descendants thanking me, Bollywood ishtyle. :D

I suggest we mail them our 2008 W2s and show them the taxes that we have paid here .....and that they are and will loose that tax dollar if there is no reform.
Send a copy of the W2 along with a brief letter to Mr President at the White House as well
We have to to talk to them in the language that they understand.
It is a capitalist country ...... Show them the power of dollars that we pay to them in taxes and that they could very well loose that along with the hi tech edge that they claim to have .
Add to it , that Immigrants are investing money off shore in real estate and businesses due to the instability and volatility of the Immi system

There could be other ways to communicate the tax contribution (if that is what you intend) of legal immigrants. Also, please note that even if you are not given a GC, the IRS will still recieve your tax, right? they already know that we pay tax (actually not pay... its collected before we get our pay). Now they are trying desperately to find out legal immigrants who are not being paid and cancel their visas.

I called the USCIS this morning for my receipt numbers, USCIS person said we have lot of applications,you have to wait 3 months to get receipt notice since you applied. My application sent to the Lawyer June 1st, The stupid Lawer took 19 days to read my application, lawyer sent my application on june 19th.

I have changed my monthly contribution from $20 to $50.
And I plan to contribute a bigger amount very soon...
My "Card Production Ordered" mail is out, but still I believe this forum will have my support for a loooooong time...
I personally feel very proud to be part of this group. This group has given all of us an identity and reason to work together and traverse the system as a group....Just remember a couple of years back when all we could do is silently and helplessly read the news on the forums and feel miserable...
Now we have to strength and we need to grow stronger. We have the confidence that we can turn around and change a lot of things. For motivation just look at the pictures posted on the BusinessWeek article.

There is only one way out - find a new job . What your employer is doing is how the H1 process is designed to be. If the employer does not have a job for his employee he is supposed to inform the INS by law that he is withdrawing the H1 and terminate your employment. Your employer was kind enough to not withdraw your H1 even after a month .
If you want to continue on H1 you can try transferring your H1 to another employer before he revokes this H1 . You will need current paystubs for that or at least an explanation of the missing paystubs for the last one month.

Looks like there are very few Eb3 approvals so far this year compared to flood of approvals for Eb2 which caused it's retrogression.
Once they start approving Eb3 there is a good chance that it might retrogress further than Eb2

2 main issues
1) Major delays in LC pre PERM. My PD is August 2001 and my LC was approved in October 2005. What took 4 yrs now takes 1-2 months. Different states had different rules some went through and some got stuck - very unfair process. Some con ass consulting companies were just starting shell offices in states with faster LC without actual operations there just for faster LC.
2) USCIS is approving I 485's based on RD and not PD. So you have situation where ppl with later PD have 485 processed and waiting on PD to get current and those with old PD still waiting for their files to be reviewed. USCIS needs to start approving cases based on PD and not RD. So someone with old PD and new RD should take prescedence over someone with old RD but newer PD.

My employer is willing to file for my Green Card in EB2 category, we have already file for my GC in EB3 category with an approved I-140 PD 2008.
Question is, the Job title is same in both the cases but the job description has additional responsibilities in case of EB2 category and needs a Masters Degree. I do have a Masters Degree, but could this be a problem with USCIS, does the job title needs to be different, and how different should be job description from the EB3 category.
Also what are other things we should take care of while porting the GC from EB3 to EB2 Category.
Any suggestions greatly appreciated.

I echo Walking Dude's comment. You can either keep complaining about how the immigration system is failing you and how unfair it is OR you can take action and actually DO something about it. Please participate in IV's campaign if you haven't already done so. AND please motivate OTHERS to participate as well. It will only take 10 minutes of your time.

I will have to relocate to India for period of one year because of critical family issues. I have GC pending with company X and have AP and EAD and currently on H1B.
I have following qns
-Once i go to India, Can i work for other employer Y for 1 year and then once I come back to US ,can i join with employer X on H1B and continue with GC processing?
- Is this cause any problem for my H1B petition /Greencard process) - Leaving company in middle and rejoining them later ?
- Will i have to face any question when i go for H1B visa extension stamping in India while i work for employer Y
- What's the approach I should be taking at this point. I'm totally confused...not in a position to take any decisions. Please help me !!!

On the flip side , I see this as an end to desi consulting. Once everybody uses Ac21 and moves on (And I know most of them stayed until now just for the sake of GC). And there are not enough H1B's to replenish a new batch of people for these companies to continue in their current business model.This will result in a natural death for the business model of holding H1b's.
unless the H1 quota is increased again, without a corresponding increase in GC quotas. In any case there are 65K new H1s coming in every year, a number of whom are going to be working for desi consulting companies. With the current GC queue almost none of those from india, china or EB3-ROW is going to be filing a 485 anytime soon. Some of the H1s who end up full time will get laid off if there is a recession, and the only ones hiring in bad times are the desi consulting companies. These people will get stuck with the consulting companies. So no, they are NOT going away.

Just a friendly advice. To my understanding, Visa officer also have do name check for visa stamping. Though 99% people get through the name check specially if you are not from a Muslim country or do not have a Muslim name. I personally know couple of cases in past (Pakistani National�s) where people went to Canada for stamping and got struck in name check for three months +. One of them was a PHD Doctor. As I mentioned above, you do not need to worry about this since this is a very small percentage and I have a feeling you are Indian National, but one should be mentally ready for every thing.

Also, if you see the history of NSC on approval notices sent , this might make sense. Example did anyone observed this trend in EAD approvals from NSC? My Approval notice for EAD says that the Case is approved on 12/11/07, however the Card expiration date was valid from 12/05/2007 to 12/04/2008. A gap of 8 days between date sent and actual approval

I agree with this logic, updating all the cases during weekend - and I think NSC updates CRIS in batch mode. However concern remains that nothing was updated on Aug 2-3. Hope that some update happens on Aug 9-10.

I did not know 40-50% indians were in that age group. This is Huge, India will come back in every sphere, because of this statistic alone. outsourcing is only a drop in the ocean when you look at these numbers. These numbers "may" also mean that about 20-30% population in the world for people around age 25 would be Indians.
The Basic problem still remains (Roads, Water, Electricity, Sewage) and the root cause is corruption at all levels.
