I did invoke AC 21 before my GC was approved, but I am not sure if my AC 21 request was updated by USCIS, FYI... I notified USCIS about 3 months before my approval. wondering if you received any RFE for EVL before your GC approval or else just got approved. Did the officer who interviewed you for your citizenship asked about your job change specifically? Appreciate your response

No, I didn't receive any RFE, I submitted new employer letter along with cover letter when I changed my job using AC-21. I got straight approval after 11 months of sending letter without RFE.

This came up while going over employment history in the N-400 application. To my surprise, my AC-21 letter was in the USCIS file with the IO. There were couple of questions regarding Job Title, Desc, Salary and Duration. I was the AC-21 employer for almost 5 years - 1 year before I-485 approval and 4 years after that.

My AP was received by USCIS on Oct. 21. No checks encashed yet. I believe there is a receipting delay of AP applications at NSC.

AC21 is when you have applied for a 485 and it has been 180 days (6 months) and you still havent had it approved. basically you can change jobs as long as you have valid EAD and AP. You dont need to apply for it, you can change jobs after 180 days are up. It is recommended that you inform the USCIS.
i think there is a caveat here. you have to have 140 approved before your 180 days counter starts. can someone confirm please?

usually EAD takes 90 days but visit your local congressman/senator office and explain them the situation and ask them to help to expediate the EAD renewal, usually they check your case with USCIS and it might work (depends on the officer who reviews your case too). hope the situation resolves soon, good luck.

Long shot - any idea how many EB3 are pending (I458s + I140s waiting for PD to be current)?. Just trying to estimate with current rate of 3k EB3 per year, how long it will take to clear the backlog untill PD March 2010 :)
No of Eb3 pending till Jan 2010 = 60,050
Total Wait time = 60,050 / 2,987 (annual quota for India Eb3) = 20 years (approx)
However a lot of ppl will lose jobs and their green card process doomed, move from eb3 to eb2, some will abandon their gc dream and go back to india. So 7-8 years would be the realistic timeline.

I want to know what kind of jobs can a person on H4 status take after getting an EAD, any jobs like in wmart,etc or a good bank job or any high class reputed job, i am asking this as do the uscis see what kind of jobs the dependent on H4 visa did after getting their ead before adjusting their or before giving Greencard.

First the good news. I made a trip back to Pakistan and got married on 11th March:p. My 1-485 is still pending. I want to know what are my options now to bring my wife to U.S.
My priority date is Dec 2003, so if everything goes according to plan, i might get my actual card in couple of months (hopefully). Can anyone guide me what i need to do now since I got married before i-485 approval. Should I go for Follow to join option or bring my spouse on h4. Any input will be much appreciated. :D:D

When we renew our EAD's online , after paying fees etc don't we get a number we are supposed to call to take an appoitment for FP at our local ASC?
I remember doing something similar for getting my OPT card .. so i am assuming the same for EAD renewal..

This information cannot be confirmed at this time. There is no internal memo or information to prove that that it maybe true. Even if this is suspended, it maybe because USCIS does not have enough resources at this time. It seems they are getting lot of pressure to clear the naturalization case backlog. There was a recent hearing on this topic.
EB immigrant applications have not generated enough pressure on USCIS to adjudicate cases faster. If people think this EB immigration backlogs are important for the administration to clear, they need to send letters in several thousands and not in hundreds.
Pre-adjudication does will not really have much difference in the current situation. If dates do not move forward, it will be of no use. Even if the cases are pre-adjudicated now, and dates move forward several months from now, there is still a chance of an RFE or an interview. USCIS can issue an RFE for current employment.

I am pretty sure none from July 2nd would get picked. We have had one report of someones check for I485 being cashed. Other than that not a single report of acceptance or checks cashing, out of 20-40k(my assumption not a fact) which were delivered on 2nd July.

You can extend your h1 by 3 years on your 140 approval. I have done same in my case. But i am not sure whether it has to be done by only current employer or any one. I would suggest get it done by your current employer

I am on H4 and my husband's company has files H1-B visa for me in 2007 quota. Will this file considered as H4 to H1 Change of Status case or fresh H1-B case?
And normally how long time its takes to get approval for H1-B? My company files H1-B for me in April so when (around) can I expect H1-B approval?
Because I am planning to visit Canada but somebody told me that if I am in US on H4 and H1-B is filed then I must not leave US till I get H1-B approval.
Please help me if you have answers of these questions.
