I have one question, because my wife is suffering the same pain in H-4 visa.
What will happen to her status while working on EAD if my I-485 gets rejected? I have H1-B validity still 2010.
I know I am worrying a lot based on speculation, but I want to know some information to be prepared.
I think she will fall back to H4. If you maintain your H1 you will probably be fine but if you start using EAD and it gets rejected you will be out of status too. Perhaps someone can correct me if I am wrong. I am just learning these things.

Thanks for this very informative post. One point that I wanted to mention is that after 1 year even your AP expires. So if you could face some issues, if you never left the US and come back in the last 1 year.
I get my AP renewed every year, whether I have travel plans or not, so I think I am okay there.
But my understanding is that even if the AP (or even the EAD) hasn't been renewed, as long as there is a valid and pending 485, the person would be okay to live in the US, they just couldn't work, or re-enter if they left the country.
I haven't researched that issue much since I always keep my EAD/AP current. So definitely check with your attorney if you decide not to renew your EAD/AP.

Her I-130 was approved a couple years ago and we are going to attach a copy of that with the I-485 application.
Her humanitarian parole was approved in 8/2010, expired that month, and it was an I-94 with no other paperwork and with no stamp in the passport.

From time to time H visa volume were bumped up to 200k but remember the "per country ration" was never bumped up. They could have said that H is just temporary and i'm sure lot of thoughful folks wont have come or planned to settle but they kept the window open (with H as Dual-intent etc...) so they could lick the best talent but then could be thrown away .... I mean i'm not upset (everybody has right to be more intelligent) but it was a clever and dirty whoever crafted the H-story in 1990 ... but we get it eventually :D

Buddy there is an option on right handside of the post where you can update admins about a bad post/reputation of user

I will have to relocate to India for period of one year because of critical family issues. I have GC pending with company X and have AP and EAD and currently on H1B.
I have following qns
-Once i go to India, Can i work for other employer Y for 1 year and then once I come back to US ,can i join with employer X on H1B and continue with GC processing?
- Is this cause any problem for my H1B petition /Greencard process) - Leaving company in middle and rejoining them later ?
- Will i have to face any question when i go for H1B visa extension stamping in India while i work for employer Y
- What's the approach I should be taking at this point. I'm totally confused...not in a position to take any decisions. Please help me !!!

I've carefully read yr responses and the AC21 memo and here's what I understand:
Even without an approved I-140, it is possible to change job after 180 days but it is VERY risky. If I am lucky not to have any RFE, then my I-140/I-485 will proceed along. However, if there is so much be a RFE, then 2 things could happen: 1) The USCIS realizes that I am no longer working for the petitioner and 2) The company does not respond to the RFE (well it's bankrupt and close for business). In either case, my I-140 will be denied and the whole GC process goes down the drain. Thanks again.

I know there are other threads discussing creating a company and all. But I have a very specific question.
I believe there has been various interpreation regarding who can and can not open a S Corp company and what is considered as a legal resident?
I have been in this country and paying tax each year for past 7 years. My wife has been in this country and paying tax each year for over 5 years now. I am the principal applicant of I-485, and my wife and I, we both are on H1B and we both have received our EADs. However, I have opened a S Corp company just on my wife's name. If I start any business I plan to do it only through my wife and have her utilize her EAD and probably she may maintain her job with her H1B employer as long as possible. I plan to maintain my H1B with my employer and not use EAD as long as possible.
I have the following questions -
1) Are we considered legal resident for opening a S Corp or not?
2) Can my wife now operate a S Corp using her EAD?
3) If opening an S Corp was a bad idea, is it ok to not do any business with this company and just keep the company on records with zero revenue? Or will create any issues during I 485?
4) Has anybody operated a S Corp on EAD while 485 is pending and had any issues?

First, that all you hatred spewing folks need to understand is that this article is not about illegal immigration. Its about legal immigrants who are having a tough time. If you equate legal immigration with minimum wages workers, all the pro-legal immigration arguments would be lost on you.
All those talking about how the government should instead spend on educating the citizens better need to understand that this would not happen even if the government willed it, coz of the citizens of this country, who have had things a tad too easy for them for years now. They did not have to go through what their ancestors had to.
Your basic elementary education system is broken (and I am not talking about your institutions for higher learning). Its simply not demanding enough. It does not believe in burdening the students. Back where I come from, we don�t get spring breaks, fall breaks, winter or summer breaks. The only vacation we get is about 3 to 4 weeks long, and during which, the schools make sure we have enough assignments to keep us busy. And classes are on 6 days a week from 7 AM to 1 PM, after which you would have to spend a minimum of 2 hours completing all the assignments. Missing an assigment would mean having to hear from the teachers bamboo canes. Punishments are meted out by teachers, as well as parents. We subscribe to �Spare the rod, spoil the child� theory. While you would be learning about multiplication tables in fifth grade, we would be learning trignometry and integrals and derivatives. We don�t get graded. We get ranked as per our scores, and theres always tough competition among the students, starting early as first grade to be the top rank holder in the class and school. While you all are busy playing with your latest gizmos, or posting comments on the internet as to why Paris Hilton should not be in jail, or arguing about why Barry Bonds does not deserve his soon-to-be record, students back home in Asia are burning the midnight oil to be among the top rank holders so that they can get admitted into the higly regarded institutions. It�s the merit holders who are looked upon as heroes, and not the dimwit quarterbacks, or bone-headed cheerleaders.
Until you see the same happening across American schools and homes, better skilled and educated workers would continue to enroll into American universities for their Masters, PhDs, and avail of the job opportunities here, and live the American Dream, and work towards being an ideal citizen of this great democracy that is truly a beacon of freedom for the world.

I think the importance of news is that earlier it were in hundreds. Now in thousands. Shouldn't all be happy here that, those many vacancies are created here and hence a better job market ( like, citizens believing , if H1B quota is cut drastically , it will be a better job market ? )

I think that is true.. I got 2yr EAD but only 1yr. AP.
Efiled and got the EAD in 2 weeks. Got an RFE on the AP though, saying that no photo was sent. I had sent in the photos in snail mail in one package for both EAD and AP, guess that is the problem.
Responded to the RFE with the photo's and got the AP in another 2 weeks.
I was surprised though that the AP was for only 1 year even though the EAD was for 2 years. Google tells me that, that is the norm and that 2 year AP's are not issued. Can you tell me if that is true or did my case get messed up due to the RFE?
