    Even if that is cheating, vendor has no right to hold the money legally. IF he finds any misconduct in that, he can file a lawsuit, but with holding money is not the way.

    How about changing jobs after recieving GC? Can we switch to the job we like with out any regards to changes in job duties? how about taking a break?

    As mentioned in my previous post, one should at least stay with their employer, at the time of GC approval, for around 6 months to a year .

    Then again, nothing about the time line is case in stone (that is nothing is said in the law books). However the shorter the duration, the more the burden on you to prove that you did not get your GC with no intention of working for the employer.

    As someone else mentioned AC21 invalidates the requirement that you need to work for the same employer. That is a gray zone. Based on my understanding:

    1) When applying for any stage of the processing, you need to have intent to work for the employer (otherwise, legally you have committed fraud).

    2) Even with AC21, I believe you need to stay with your then current employer for some period of time after getting GC.

    I know people who have left their jobs within a month of two of their GC and have had no problems even with their citizenship. So it is up to you to maintain your own good sense of security on how long you want to stay with a company after GC. Most lawyers' opinion is to stay for at least a year - provided (their boiler plate advice) that you dont have premeditated intention to leave.


    Once you are happy and secure with the "cooling off" period after GC, you can work in any field (not meant to deride, but you could also work as a hamburger flipper if you so choose), or take a break.

    When they start processing the 485 AOS,they allot visa number.
    If it retrogressed but visa number had alreday been alotted to her case,approval is possible,otherwise June 2005 approval is not possible.
    If it happened,it means august bulletin might have June 2005 as cutoff date(they secretly changed the July VB and changed it back to "U" from "C"

    If you quit this job and find another on AC21 portability both of your i-485 is valid. Even at the time of GC if you have a valid job on Ac21 portability then no problem.

    The problem occurs when USCIS issue an RFE to get more evidence to see if he is still a dependent. They may ask for join bank acc or house on both name or marriage certificate and proof so on to prove u both are husband and Wife...

    If thier is no proof to provide this then his i-485 will be denied along with EAD and AP.

    I suggest you to think over this comely. You can even pray to god tell him what u are undergoing now. And from my heart I suggest u to please stop applying for divorce. May be u can live separately for a while that will give some time to settle down and wipe out the bad moments between you two. And some time later I assure you both will live happily together.

    I submitted labor certification in 2004, EB3 have been waiting since then...in the meantime my husband and I are separating. I was the primary on the green card case.

    If I quit my job, is he gonna loose his EAD, or the EAD remains valid until the validity date?
    Does he have options to still keep the green card case open under his name?

    I would appreciate any input. My personal life couldn't weather the long wait, but I am really worried that he would loose all his papers if I quit.
    It would be great to know what his options are.

    I was cheated by one of the fraudulent
    desi consulting companies. I could not
    disclose the details of the cheating
    pubicly.

    Instead of just tolerating silently, I would
    like to do, whatever possible, so that,
    atleast, he will not do the same with

    I would like to file a complaint to USCIS.

    Does anyone know the process to file a
    complaint to USCIS ? What is involved

    I am working with one of the best company in USA with a very good salary. before joining this company I was working with a company who filed for my LC and 140. It is approved.
    Now my new company has yet to file my labour.
    My old employer is not willing to port the old dates as well not ready to file my 485 even if I gave him money.
    Now with the new bill I am afraid that I no longer can apply for extension as I have yet to file for my labour. I have 2 years left.
    the old employer is asking me to join him. It will be a big risk considering the fact that if the bill doesn't pass I might loose my existing super nice job.
    What would you do if you were in my situation?:(

    When your new company is going to file for labor? If they can file the PERM in with in next month then there are chances that you can get labor approved in few days/weeks. If PD still current you can file 485. It is very difficult to leave good company but in bad time good company may turn bad. Do you have any option to join back your good company after 6 months if you decide to join back your old Not so good company?

    It is certainly not out of their (NSC's) league to do something like that - work on the case w/o posting a LUD and approve them/send notices in batch.

    I think it is possible to data mine the case status from USCIS site quite easily. Based on the case number decode it is possible to write a routine to go through all the cases in sequence and extract the information. I believe that is what ImmigrationWatch is doing. What is lacking there is the country of chargeability - which is not available on the case status display.

    In any case I hope - IO at NSC wakes up from their hibernation and starts working. May be they are waiting for the flowers from IV members :)

    Something tells me that NSC might be working on 485 cases like TSC with an exception of sending or updating the approval notices as and when they are completed.

    Maybe they will send all the approval notices this weekend for the cases being worked on till now.

    After seeing the Immigrationwatch on the number of approvals and cases touched at NSC(not sure how reliable this is)but , this might be the case.

    Also, if you see the history of NSC on approval notices sent , this might make sense. Example did anyone observed this trend in EAD approvals from NSC? My Approval notice for EAD says that the Case is approved on 12/11/07, however the Card expiration date was valid from 12/05/2007 to 12/04/2008. A gap of 8 days between date sent and actual approval

    I know, It may be dumb quetion and So many people already asked. But I have some comments from Ron Gotcher and need seniors suggessions.

    I am recently joined new company and my 485 is Pending. I contacted with RON GROTCHER LAW Firm. Here is their Advice

    "Our office recommends that you do not invoke AC-21 due to the
    unnecessary
    delays that can be caused by such a notification. You are not required
    by
    any law to notify the USCIS of your change of employment. In the event
    the
    USCIS issues an RFE requesting an update in your employment, we may
    then
    provide the information. It is extremely important that you do not
    provide
    information to the USCIS unless it is requested. This will prevent any
    further inquiries from their Service, which could very well result in
    delays"

    If recession remains same as of today and slower labor approvals for Eb2 then Eb2 will be C with in year and then all quota will fall to Eb3 .. Which will speed up Eb3 India.

    if USCIS has 180k app in backlog and 140k out of that is for india and if India gets 30k in spill for next 3 years then backlog will be cleared in 3 years and new people will be very less because of economy so in next 2 years after those 3 years all dates should be C or close to C..

    backlog will happen again after that though..

    Good thinking. But USCIS is not approving all 30K for India. They approve only about 5K for the whole YEAR.

    So it still takes 18 Years to clear the back log.

    if there is no person with the name of Arun Vakil working or was working in the Mumbai consolate , then

    1) you should not feel offeneded and take time off from you busy schedule to try explain this

    So you write nasty things about a person and that person has no reason to respond. I think you are hiding something here. Infact given the tenor of your post I doubt you can really be trusted. Donot I repeat donot take IV members for a ride.

    2)If you do not work in the mumbai consolate or are associated with the mumbai consolate , how do you that there is no person who was working in the consolate

    is it safe to assume either that you have access to all the list of persons in the consolate

    I donot think it is really difficult to find out who the consular officers are. Here I am not talking of the minions who just do paperwork but the actual State Department people posted to take interviews and provide visas.

    or you are GOD cause only God can tell us all the name of persons working
    in the consolate , and i strictly believe that it not the later , you might be the opposite of GOD

    But this is not going to end here , it is just the begining
    as you might be aware that i can show you proof if things get out of hand

    Yeah sure! given that you are threatening people I think you should atleast provide some proof.

    Here is what I think has happened. Your parents went to this gentleman for advice. Maybe you even paid a certain amount. Ultimately things didn't work out and you must have asked for a refund which of course this gentleman refused. And now you think you are doing everybody a great service by starting this on IV.

    Could you please point out what you've actually done for the goals of IV. Or are you using IV mislead people.
