I am pretty sure none from July 2nd would get picked. We have had one report of someones check for I485 being cashed. Other than that not a single report of acceptance or checks cashing, out of 20-40k(my assumption not a fact) which were delivered on 2nd July.

Hi,
I have also re-scheduled my wifes FP appointment about 2 weeks ago and have not got the new appointment yet.I did mention in the letter what time frame my wife will be unavailable. I talked with USCIS customer support and they said that it might take couple of weeks to few months to get the next appointment.

Thanks for your replies and good luck with your respective job searches.
Fshah: I don't know if we can just work without pay. But if the employer really likes you, you can always be in touch with them and start working once you get the EAD.
quizzer: Sure, we can be in touch and share our ideas to get a job. I live in Wisconsin. just email me. My approach has been to submit my resume via employer website and also calling the offices directly and ask for the recruiter(tax/audit). California has a lot of openings for CPA(accountants).

theoretically yes.
but won't the unused EB1 numbers roll into EB2 ? remember, each of EB1, EB2 and EB3 are at 28.6% of country quota (7.1% each for EB4 and EB5). there are never enough guys to fill EB1, so EB2 benefits from it.
there will not be any unused EB2 numbers rolling into EB3 ...
In fact there are more than 'enough' guys in EB1. EB1 remains current just because there are not enough guys in EB4 & EB5. If you look at numbers, EB1 numbers are not rolling in EB2

just thought I would add an interesting tidbit many people may not be aware of.
Most white Americans here are actually of German origin. I understand America has a different history from Germany in the last 200-300 years, especially from the point of immigration.
Germany's politicians have tried to make that country's policies, somewhat similar to the USA as far as immigration, and there are a lot of immigrants in that country too. They also want to attract the best people.
They were very vocal about their support for President Obama before the elections.

In my case, my I140 approved 1 year back and I applied I485 more than 2yrs back and got EAD 2yrs back.
Here letter you mean AC21 to USCIS? I heard AC21 will be filed after i join new company and after I got 3 paystubs.is that correct? In that case, if my GC sponsered employer revoked my I140 as soon as I leave him and before I complete 3 months with my new employer, how can I survive?will it be safe?

Sorry, this maybe in the wrong forum...but I was wondering if you guys can help me at all. Here's the situation...
Fiance and I will be getting married this June on the 5th. She is from Japan currently here on a F1 (i believe) student Visa. What is the required paperwork we'd need to do and also what is the process like to get the green card for her. I am a citizen born in the USA.
I read up about it on the UCIS website but I'm un sure if i need the I-130 I-140 or what? I assume if I need both I have to fill out other paperwork as well (the verification of support financially) and the background info papers for both of us?
Sorry, I'm just really confused, their site doesn't provide much help, nor does the 1800#. I do have an appointment schedule for the local office, but I wanted to be more prepared.
Also, what tests does she have to get done? Medical? And interview also? What is the cost?
My last question is, what is the turn around time like? Due to her graduating already, she only has 1 year of OPT where she can work in the USA. This will expire in September of this year. Will she be able to get a temporary alien reg. number or card she can give her employer or will she have to return to Japan?

I recently got a new passport issued from Indian consulate for my wife to reflect her new married name which has my first name as her last name. But her I-94 & US visa had her old name which was her maiden name. Over the last weekend, I was at the Georgia DMV office to get a learner's permit for my wife so that she could start to learn driving. I had taken all the documents needed for this purpose. At the counter, I had an issue with the lady informing me that she would go only with the name on the US Visa & what was on the I-94 and nothing else. Even though I tried to explain to her that it was her maiden name and now we have new passport with her married name and even showed her passport with my name as the spouse, my current passport, our marriage certificate, my H-1b approval document etc.. she would not budge. She informed me that the only name she would accept is the way its mentioned on I-94 and on the US visa. I did not want to argue with her and as such went ahead with her maiden name and got a new learner's permit issued with her old name. Would this be of a concern or problem with permanent residency application for my wife which I applied with her married name?
Also, she categorically informed me that she would not accept my wife's name as "WFN,HFN" (WFN:Wife's first name,HFN:Husband's first name) even if its mentioned that way on I-94 or US visa. According to her, she will only accept my wife's married as "WFN,HLN" (WFN:Wife's first name,HLN:Husband's last name). Her reasoning is that my wife is supposed to carry my last name like the culture in US and not the way it works in Indian culture where the wife gets husband's first name as her last name. hi guys, i sick and tired and finally decided to get my passport, from consulate and use ap to get to us. i did talk to consulate, they will continue to process my h1b, while i go on ap. my attroney did tell that i can go back to h1b if they process visa and enter on h1b. Only god knows what i am doing, taking risk, without h1b stamping, using AP without i140 approved. I am believer `one who dares, is one who ones ` i am taking risks, wish me luck and good luck to all guys who helped, hope you get your visas and gc. god bless.

If you read the PDF link of USCIS, it clearly mentions that this only applies for people who concurrently file 485. And not to people who have seperately filed 485 and EAD. In my case, my EAD was filed 2 months after filing 485.

If one gets an EAD after filing for 485, then what do we mean by saying that H1 gets invalid by utilizing EAD.
Assuming that an employee has 3 years remaining in his/her H1 with company "A" and got his/her EAD recently, then how can he/she utilize EAD to continue working with company "A"?
I'm in th same boat. I need a H1-B extension starting from OCT 25. Let's say I file 485 and EAD on july 1, it will take 90 days to get EAD, which is OCT 1. (If I dont get it in 90 days, I'll go and get an interim EAD). Do I even have to file the H1-B extension? (I can save $5,000). Are there any risks? My company lawyer already started processing H1-B but did not apply yet. Now lawyer is planning to apply both H-1B and 485 at the same time. does this make sense?

Read somewhere that even if GC is approved and 6 months is not banked with the sponsoring employer, there may be problems at N400 stage(citizenship). As I said, I just read it somewhere on this site.
So far all this is speculation. Though the idea of having to work for the sponsoring employer for sometime after GC approval is doing its rounds, there is no concrete example anywhere of it having an adverse impact on citizenship.
Ac21 is even worse...but it is law and citizenship cannot be denied for this.

Profitwise:-> Both companies are rock solid when it comes to profitablility and stability. Both have revenues of excess of $8billion/year.
I am getting a raise fo 20% over my current salary.
Workwise:-> The new offer seems little bit better than the present one
The title itself is good " Internet Architect" for the new offer.
Benefits:-> They are kind of comparable
Growth:-> Difficult to answer but the present company is into Telecomm Technology and new offer is from a company into financial services. I am into core IT infrastructure. So the probability of my job getting outsource is more by my present employer rather than by my new job offer. Both company has quite a bit of growth left in US sites.
One more thing:->
My family ( wife + son ) is kind of well settled in our current place, so moving them would be a bit painful for them also.
Also, I kind of like my present job because of few reasons:
1) I am well settled in my company; people recognizes me for my abilities here
2) My family is well settled
3) I am in San Diego and I love the weather here. My new job is in San Dimas which is a bit hot w.r.t. San Diego
Guys-> I am confused here.

Are they preparing for BIG spillover right from this month or am I reading too much between the lines.
I don't think we can imply anything as this statement was in the last 2 released monthly info too.
