This is the exact RFE that I am fearful of....
Being laid of from job 2 months back and unable to find another job (with all the strings and labor conditions attached)....and my company had revoked my H1-B (I-140 is still valid)....I am expecting a similar RFE soon ....needless to say that I'd be doomed if I receive one and no one has an answer to that after waiting this long for the elusive card only to go back becoz of the recession.
What a pity...

We had applied for H1B extension and was approved last week at CSC. My husband is travelling to India this month and will use AP to enter hence will be paroled. He wants to be in H1B status so please advise us on what we have to do after entering US with AP so that he continues to be in H1B status.

Have the same #. You are right. Also for my dependents. Airport issued I-94s and I-94s in Approval Notices. Since 1999.
If you have the i-94 on your renewed h1 (borrom of 1-129), that will do. Because the airport 1-94 number and this number will be exactly same.

I did invoke AC 21 before my GC was approved, but I am not sure if my AC 21 request was updated by USCIS, FYI... I notified USCIS about 3 months before my approval. wondering if you received any RFE for EVL before your GC approval or else just got approved. Did the officer who interviewed you for your citizenship asked about your job change specifically? Appreciate your response

No, I didn't receive any RFE, I submitted new employer letter along with cover letter when I changed my job using AC-21. I got straight approval after 11 months of sending letter without RFE.

This came up while going over employment history in the N-400 application. To my surprise, my AC-21 letter was in the USCIS file with the IO. There were couple of questions regarding Job Title, Desc, Salary and Duration. I was the AC-21 employer for almost 5 years - 1 year before I-485 approval and 4 years after that.

Consistent behavior! The thread goes dead generally after a post like the one above.
Everyone wants results without working for it. Everyone has ideas as long as someone else works on it. Everyone wants IV to do all the work and then most blame IV for not getting the results they never labored for!!
Most of our members have a family, most of our members have full time jobs, most of our members are stuck in the GC process, but cannot spare a couple of hours for IV efforts (which benefits them) every week to get the relief needed...

AC-21 does not permit free job change. The new job needs to be same/similar as I-140 job.
I did use AC-21 and I was asked about it at the time of N-400 citizenship interview. My 2 cents.

Its time to prove that you guys work in the ECONOMIC CAPITAL OF THE WORLD!
Pull up your slevees and start planning...
Most of the TV stations are in NY, so start planning for the rally soon...sometime late OCT....The weather should be good for wearing formal suits.....
Imagine 1000+ people dressed in formal suits, walking in NY streets in front of all those big ompanies...it will be a huge media attraction....
Just two rallies is not enough......Every state should do this!!!!
This time we will get it straight about adding
"Legal Immigrants - Highly skilled workers" at the bottom of all the slogans....
U will see the same folks coming from CA WA TX MN etc... NY Nj folks have been hopeless

Many lessons to be learned from this failure....... Obama has no choice in the matter of deportation. As the executive body of the govt, he has to enforce the law - and Guiterrez's argument that Obama did not get anything in return is just wrong. Second of all, in the two years, he should have given way to peicemeal approach - especially after seeing how the Health Care had a tough time........
But that still leaves us in cold. We have to meet with lawmakers and get their support on our issues. We cannot wait for our issues to be attached to other bills without doing the ground work.

My friend works for IBM, he has been given two choices (a) take a pink slip or (b) goto India and keep the same job w/ good perks. Given the economic situation, he opted for (b).
True. Some folks has been provided with option to work in India and else where under the terms of labor/employment in local country/location. They also process visa for US Citizens if they are interested. There were few news articles couple months back, when there was layoff, though IBM did not report then officially. Any company is not mandated to do so, if the % of employees affected are below certain amount. Some estimates say it is close to 5000 not including the current announcement. I do have friends in this company who lost jobs last time and from what I heard they let go even some senior managers and executives as well. Also these companies do have more head count in certain groups more than they need and old time IBMer do cost more to company with 5 weeks paid vacation in addition to other holidays and also long time IBMer do get pension, etc.. The company is taking advantage of the present economic condition to organize some of these groups. Never the less, these huge companies do not grow too much with economy growth or cripple down with economy with it goes down. In spite of all this, these company will still be doing well.. Also if the rumored take over of SUN by IBM goes through, except close to 50 % of SUN employees being let go. There are few news article on major news papers.
IBM being a major public company this is making big news as their CEO is also among the inner circle with President Obama.. Also many friends I know who work for big Indian IT companies are also returning back with loads of project to execute from India.

This is my first thread in IV
I am posting my experience on cruise vacation mostly from immigrant point of view.
I am on H1 visa , valid till 2012 end..
Most of below things applicable for H1 guys only.. I am not addressing GC holders/Citizens
My trip:Newyork to Bahamas
Ship name: NCL Gem
Sailed dates: 11 December to 18th December
1. Make sure you have passports/visas are valid and they are not going to expire in next 6 months
2. if you are traveling to Bahamas,, then 100% you need Bahamas visa [I am talking about H1 guys] whether they check at port of entry or not.. But as per rule you need Visa.. For me they checked each and every time
3. There are two ways to get Bahamas visa 1. by post 2. in person..... If you choose in person, then its not needed to visit Bahamas consulate by all family members.. Only one person can submit applications for all family members... NOTE: Bahamas new york consulate is not having same day service.. You have to revisit the office as per token given to you [Mostly next day]
4. There is no need to carry your passport in Bahamas,, you can safely place it inside your state room of ship and go outside just with identity card given by Ship people [ID card means, a credit card sized smart card which will acts as your id card as well as room key]. By this you can enjoy in beach with out worrying much about spoiling/loosing passports.
5. At the time of boarding [New York], they did not collected my I-94 card.. But while coming back to New york[disembarkation], they collected my I-94 card and issued a brand new I-94 card

I am working with one of the best company in USA with a very good salary. before joining this company I was working with a company who filed for my LC and 140. It is approved.
Now my new company has yet to file my labour.
My old employer is not willing to port the old dates as well not ready to file my 485 even if I gave him money.
Now with the new bill I am afraid that I no longer can apply for extension as I have yet to file for my labour. I have 2 years left.
the old employer is asking me to join him. It will be a big risk considering the fact that if the bill doesn't pass I might loose my existing super nice job.
What would you do if you were in my situation?:(

Here is what I'll do:-
1. Will never return to an old employer. From your message itself looks he is greedy and mean. So you are never safe with him.
2. Try to convince your new company to file for labor asap and pray that once your labor is approved, dates are still current. This has slight possibility as USCIS has indicated that dates might remain current for quite a while (read immigration-law.com)
3. Try to file PERM through a third company for a future employment. Join them only if you get the labor through them and then file I140 and 485 concurrently. I've few friends who have done that. I can also suggest you a company through which you can do that but there is no guarantee they will do it for you. They did for our friends becuase they knew one of them and has a good relations.
This way you are minimizing the risk.

1) you may not be able to recapture your old PD.. as the job /field of work are different.so when u restart ur GC.. u get a new PD.....recapture is possible only if the new job is same as the previous job for which u have a LC/140 approved. (am i not right?)..
i dont know how many years of H1 you still have.. if you had couple of years left.. you should have maintained ur h1 in status.

No, I did not get it back.
It is really frustrating, everyone here will get receipts in two months.
I don't think they can withdraw your application without a reference receipt #. This happened to a case we filed before (not I-485 though) which our lawyer asked to be withdrawn. However, USCIS got confused since the file wasn't in the system yet. Once application to be withdrawn got into the system, USCIS withdrew the wrong approved file. So our lawyer had to resend another letter to correct their mistake. USCIS complied and corrected their error.
I hope I am wrong but this only means that they can only withdraw your July 2nd request once they receipted it. Then you will have a record in their system that you have applied before.
