Actually the question about whether a passport is needed or not for travel to Hawaii is a good question. Are we absoulutely sure that even a passport is not needed?

Are you guys saying that:
If I have an expired H1 visa in my passport but I have a valid H1 extension I797 with a valid I-94, I can re-enter US withing 30 days after leaving US to canada? Is that true based on visa revalidation eventhough I don't have any valid stamped visa in my passport
I am from India. Ppl from Iran, syria, etc (7 countries) do not have this privilage.
You must not apply for stamping in US consulate.
You must not travel to another country from Canada
You should be back within 30 days

I donot think it is really difficult to find out who the consular officers are. Here I am not talking of the minions who just do paperwork but the actual State Department people posted to take interviews and provide visas.

Here is what I think has happened. Your parents went to this gentleman for advice. Maybe you even paid a certain amount. Ultimately things didn't work out and you must have asked for a refund which of course this gentleman refused. And now you think you are doing everybody a great service by starting this on IV.

Of an estimated 73-hundred US tech startups founded by immigrants, 26 per cent have Indian founders, CEOs, presidents or head researchers, a new study says.
"Indians have beaten the Chinese in start-up hotbeds like Silicon Valley with a share of 15.5 per cent, up from 7 per cent between 1980 to 1998," says the study, ‘Silicon Valley's New Immigrant Entrepreneurs’, by researchers in the master of engineering management programme at the Pratt School of Engineering at the Duke University.
The study, which covered 28,766 firms with annual sales of more than USD 1 million and 20 or more employees, comes nearly eight years after an influential report from the University of California, Berkeley, on the impact of foreign-born entrepreneurs.
"This study shows the tremendous contribution immigrants in general and Indians in particular are making to the US economy and global competitiveness. This is a win-win for America and for the immigrants that make it here," Vivek Wadhwa, Delhi-born Duke's executive in residence and the founder of two tech startups in North Carolina's Research Triangle said.
Wadhwa, project's lead researcher, stressed that "the country should make the most of its ability to "get the best and brightest from around the world."
"Indians constitute less than one per cent of the US population and are starting many times the businesses as other groups. They are creating jobs and contributing tens of billions to the US economy. Without Indian entrepreneurs, it would not be the same", Wadhwa said.
AnnaLee Saxenian, study co-author and dean of the School of Information at UC-Berkeley, estimated immigrants founded about 25 per cent of Silicon Valley tech companies in 1999.
The Duke study found the percentage had more than doubled, to 52 per cent in 2005. The research debunks some recent myths about the notion that immigrants who come to the United States take jobs from Americans.
"The advantage of entrepreneurs is that they're generally creating new opportunities and new wealth that didn't even exist before them," Saxenian said.
"Just by leaving your home country, you're taking a risk, and that means you're willing to take risks in business. You put them in an environment that supports entrepreneurship, and this is the logical outcome."
Immigrants from the UK set up 7.1 per cent of the companies, followed by China with 6.9 per cent and Taiwan with 5.8 per cent.
Immigrant entrepreneurs' companies employed 450,000 workers and generated USD 52 billion in sales in 2005, according to the survey.
The share of Chinese and Taiwanese start-ups, which was 17 per cent in 1990-98 period, came down to 12.8 per cent between 1995 and 2005. The report adds that the number of Indian scientists and engineers in Silicon Valley has grown by 646 per cent between 1990 and 2000.
Indian immigrants dominated even on a state-wise basis. While in New Jersey, the share of Indian start-ups was a whopping 47 per cent, in Texas, it stood at 25 per cent. This was followed by California with 20 per cent, Florida with 18 per cent, New York with 14 per cent and Massachusetts with 10 per cent.
The study reveals that California, which houses the Silicon Valley, has emerged as the favourite destination for immigrant Indian entrepreneurs.
Around 26 per cent Indian startups were set up there. Around 36 per cent companies in the software sector were Indian, while in the innovation and manufacturing-related services, the figure was 24 per cent. In semiconductors, Indian start-ups shared the top place with the Chinese with a share of 15 per cent each.

It is not a good idea to open an S-Corp. If you want an incorporation a C- Corp is a better Idea. An S-Corp is basically for citizens and has a lot of legal implications. A C-Corp is much more flexible. The best is an LLC. You get tax benifits and your liabiality is limited with an LLC. But if you intend to hire other people a C-Corp is your choice.
Why did you choose an S-Corp over an C- Corp? Any particular reason?
1) And 2)- NO
3) Keeping the company on Zero revenue is going to cost you. You have to pay yearly taxes. For e.g, in NJ you will end up paying $750 for state taxes and another approximately $140 in annual reports etc for a company with no revenue.
It might be a better idea to cut your losses and open an LLC.
I started an C-Corp 2 years ago. What ever the company earns remains in the company, I am not an employee. This is so I don't invalidate my H1. I can now work for my company though, since I have my EAD.

You are only good as the attorney representing you. So don't look for cheap and inexperienced attorneys. I burnt my fingers and that is my sincere advice. I fought a state agency on their intepretation through a top law firm and got what I wanted. Don't hesitate to believe in yourself and your idea.
And please, please, please.. Just because everyone is doing it, doesn't mean it is the right thing. Research, research, research and don't be cheap to not hire the best attorney or CPA out there to interpret/back your research. Trust me, it will save you a lot of money in the long run. Plus, Attorney's and/or CPA's will not mess with you because once you do your research and talk to them in their "language" they know that you are serious and smart.
I am lucky to have some of the best lawyers in my city working for me and my best friend's brother as the CPA. Opening a business by impulse is definitely not a good idea, but if you are adventurous and a risk taker, do what you should. Money and a good lawyer will always bail you out of any situation. 1) Fill DHS7001 and send it to the ombudsman's office. You will get an answer in 30 days from the USCIS customer service.
2) Contact the local senator. Go online and get their phone no. You can choose a dem or repub. Then call just one. They will send in a form to fill. Then you wait
3) Writ of Mandamus. If all fail try this on your own (or else hire a lawyer $3000 min). All of the above efforts will add to your case.
Dont try InfoPass since they have no clue what happening with your case. They are just like the customer service. They will help if there is some issue with EAD, AD Paro, or Fingerprinting not on processing delays.

It is now obvious..
Consistent behavior! The thread goes dead generally after a post like the one above.
Everyone wants results without working for it. Everyone has ideas as long as someone else works on it. Everyone wants IV to do all the work and then most blame IV for not getting the results they never labored for!!
Most of our members have a family, most of our members have full time jobs, most of our members are stuck in the GC process, but cannot spare a couple of hours for IV efforts (which benefits them) every week to get the relief needed...

Consistent behavior! The thread goes dead generally after a post like the one above.
Everyone wants results without working for it. Everyone has ideas as long as someone else works on it. Everyone wants IV to do all the work and then most blame IV for not getting the results they never labored for!!
Most of our members have a family, most of our members have full time jobs, most of our members are stuck in the GC process, but cannot spare a couple of hours for IV efforts (which benefits them) every week to get the relief needed...

No point in incorporating in IVs agenda, if only 100 members feel motivated to do a very simple task like writing a damn letter.
IV can keep expanding it's agenda, but what's the use if members don't act on the requested action items. Let's act to make the current actions successful first. Then we can think about other agendas.
I can't believe this crap from the USCIS.
There is absolutely no logic to the way they work.
What can we do to correct this. Maybe it can be incorporated in IVs agenda
