Am in the same boat. My PD is close to current - but haven't received FP yet. Tried calling USCIS, took Infopass appointment - nothing happened. Asked my lawyer to fax out requests to TSC (seems like a new hotline number has been opened). Keeping my fingers crossed.

When u r efilling these questions are NOT MANDATORY...when I filed for my EAD and my wife's EAD I did not answer this question...my application was accepted....

I think uscis will eventually re-instate the PP for I140 because it is huge income for them. They suspended it because they have a very massive I485 application intake at this time. Look guys, it is the end of July, and they were not even able to issue all receipt notices for I485 Jun filers. They have too much to do now and will not re-instate it until after the work load drops significantly, which could be until October or later.

I see this as a reasoned argument from the Congressman's office:
1. He says that there has been much misinformation about the H1B program.
2. In general he says that H1 workers are valuable to the country. He says that without H1Bs, American companies are forced to cut production and limit job growth.
3. He says that they don't drive down wages. On the contrary, he quotes TI as saying that for every foreigner hired as an H1B, there are 3-5 jobs created in manufacturing and support functions.
4. He says that it is so costly to hire a H1B that companies only do it because they have to, not because they want to.

Hi to all,
Is there any one to help me.My question is iam on h4 visa status.I wana apply h1 under 2007 quota.But the problem is my husband's H1 is going to be expired this september 21st.Our emloyer applies new visa before one month of expiry.If i apply for h1 is it creates any problem.I would appreciate if any body helps.

I am planning to write to USCIS Ombudsman to solicit explanation on what prompted them to make all Current in July and then retro back 7 years..

Here is my situation
I opted for renewing the AP online on Sept 22,2009.Got the receipt at the same time, and next day which is Sept 23 i sent the supporting documents along with the cover letter,2 photographs ,confirmation receipt ,485 receipt, DL copy and passport copy from Priority Mail with delivery confirmation. Today when I tried to check the status on postal website it says that document scanned on Sept 23 which means they haven't reached the destination, now this concerns me because previously when ever I applied AP and sent the supporting documents they normally take 2 to 3 business days to reach.
Now my question:
1) If suppose the AP supporting documents get lost in mail then can I send the documents again and if in the mean time postal service delivers the first set
In between I see soft LUD's of 9/25,28,30 on my AP
All responses to the above matter is highly appreciated

My friend faced the same issue when he was leasing a 2010 Nissan. He was given loan / lease only till validity of his H1B. Seems like its new thing do some financial institutes have taken this mandate seriously the other will follow eventually. Looks like H1B and home loans will soon be history.

As soon as we get our GCs, we should probably start an ImmigrationVoice Credit Union.
I think overall, Bank of America is just stupid. When I first came to the US for my Masters I went to BofA to open a checking account but they needed a min of $500 balance for a free student checking acct. Which student has $500 in the bank? I opened an account elsewhere and BofA never got to see the money I made later. I don't care if they don't want to do business with me. My only gripe is that they should tell you upfront all the conditions so I don't have my credit history ruined by needless inquiries. I'm sure there's someone else who'll take my money.

I have approved I-140 and approved EAD card (Which expiring on 12/2008) with EB2 category. I am planning to change my employer and working as Consultant for an IT company (VOLT).
Now, VOLT said that they can not send me an offer letter officially on company's letter head (they said, it somehow apply against their policy of not soponsering VISA/GC etc).
Instead they just sent me an e-mail which has just information about following:
pay rate, start date, client name, manage name, duties, title.
The question is, If I am going to file AC21 then can I used that e-mail? I have asked for offer letter on company's letter head but they denied to give that.
Also in my Labor aplication I have title "Computer Software Engineer" and new title is "Sofware Design Engineer in Test 3".
I really appriciate if someone can guide me here or provide me some info on this issue.

I would speak to my lawyer about it if I were you - dont try be sneaky - USCIS would love to kick your I-485 back for a reason like that. You never know, if your lawyer contacts USCIS they may just revise it for you without much delay.

huh ? what is wrong with the statement I made above ? Has anyone entered US with just I-797 and expired stamp ? If so, I would certainly like to know that.
First of all, you do get I-94 WITH approved I-797. Especially, if it is extension. That I-94 will have the date same as new H-1B date. So, any effort to get a I-94 at POE with that date is unnecessary.
With a valid I-94 already at hand, what one should be more concerned about is re-entry.
And krishmunn : How come "change of employer" issue suddenly comes into play ? It wasn't in the original question...Scope creep !!! You must be the IT guy !! (Just kidding...I'm too)

So I will not have a I-94 except what I get at POE.
I do not have a change of employer .. it is extension with same employer. I am banking on this -- "POE Inspector stamp the I-94 card valid until the date of the H1B approval notice with the present employer and not the earlier visa validity date stamped in the passport "

Dont seen why intorducing a provision to recapture some time would run into problems...I think that would not....any way I think you guys should dicuss this option with the lobbying firm to see what they say...it will be some kind of a band aid for our agony...

All those waiting for FP including me here is some good news if my logic is correct.
USCIS announed today that as of today( Feb 15th) they will consolidate all Biometrics for EAD and I-485. This means AS a WORST case the next time (perhaps aug-sept 08) when we will need to renew the EAD's and take FP appoitments in the local ASC it will automatically fulfill our requirement for biometrics for 485.

If you want to use probability theory your chances are 50-50 . You might get approved or might not . There is absolutely no one here ( or at USCIS ) who can definitely say that your GC will be approved in August.
No one knows how many applications are pending before you and even USCIS does not follow the FIFO procedure and also how many visa numbers are left and how many will be alotted to EB2-India.
So you see just too many variables to say anything . Go ahead and renew your EAD if you are working on EAD to be on the safe side.

Setup the email notification for status change and forget about it. Whenever anything changes except LUD which is anyway useless, you can get a notification. Dont waste your time checking status multiple times. Study or read something instead.
