Every H1 petition application carries with it the proof that the employer put up ads in local newspapers about the job vacancy. Only when no suitable applicant is available then the DOL approves the LCA..

For those who are interested, we finally received both the RFE's requesting G325A and birth certificate. We responded to the RFE and i see LUD on both the cases for 03/11 & 03/12.

I just wanted to share you a good news. My ead is set to expire on Jan 15,2009. I applied for EAD renewal after reading a lot of horror stories for renewal on this site and other sites. I applied on Sept 24,2008 (paper filed with lawyer) and posted that on the same day.
The RD for it is on 25 sept,2008 and I received CPO on 30 sept,2008

I am very confident if you take at least one infopass appointment for every week of August, u will get approved. I think u r more or less through. U just need to keep bugging USCIS every now and then - tht way they may look at your file before ppl who are ahead of u in the queue.

Nathan I am not sure why community should tolerate such rude responses from people like you. Best thing is to shut up or be polite when you do not know anything on the question.
Before posting your question read the goal and mission of IV.... We have lots junks just ask nanny questions, not even donate a penny and do not take part in any initiative... and still claiming donated more than $500 to IV. I don’t understand why this immigration community should tolerate the junks when the goal is to fix the immigration issue. We are not here to fix your naany issues specially when you do not care about the core issue and plight of the community.

How many visas have been used up so far from 140,000 quota in 2008?? Any idea?
The exact number is exactly the sort of thing they are very cloak and dagger about. My best efforts to get the number from DOS has not been successful but whatever the exact figure is, they are not on course to use up the quota. This is also confirmed by Gotcher (go read his forums).

I think a lot of guys will agree with you. I don't see why anyone will disagree. Smaller desi consulting companies do nothing except taking a chunk out of your salary and cheat you in H1/GC process. There might be exceptions though.
As for desi companies going out of business... I think their business will be significantly impacted by this because essentially USCIS with Jul 06 bulletin said everyone who came until Jul ahs a shot at freedom. So very few unfortunate souls (stuck in BEC, Atlanta, bad employer) etc will be still stuck with desi companies.

Because of all these EADs they will learn the best business practises and do the fair business. Otherwise they will be out of business. We are now looking to get an OCI for our 5 months old son (US Citizen)..but strangely saw this on the Indian consulate website... CGI SF Contents (http://www.cgisf.org/contents/view/47)
Q 6: Are minor children whose both parents are Indian citizens eligible for OCI?
Ans : No.
So did something change in the last 5 years or so ?
Our elder kid was born here in 2005 and we got her an OCI for her when she was 1 or so..

My I-485 was approved on 12/01/2010 and I have received the Welcome/Approval Notice as well. I have however not received my Green Card. Yesterday I was surprised to see an email from USCIS indicating that the online status of my case has changed to "RFE". Upon examining the Approval Notice I noticed that the PD has been misprinted - 07/01/2007 (not current for my EB Category) instead of 07/01/2005 although I am not sure if it has anything to do with the RFE?
My attorneys suggests that I need not worry about the PD misprint on the Approval Notice and that we need to wait till we receive further communication from USCIS regarding the RFE. I came across this link that however indicates that the misprint on the approval notice might cause the National Visa Center (State Department) to not issue a visa (Refer: National Visa Center (http://travel.state.gov/visa/immigrants/types/types_1309.html))
I have a trip planned to India in Jan.
*** I am wondering what this RFE AFTER an I-485 APPROVAL means? Is it just an intermediate state till they fix the approval letter, OR is it some additional info they need that they forgot to check before approving the application :confused: OR is it an erronous online status that I need not worry abt?
** I am wondering what the best course of action is? Is "wait and watch" the best thing to do or should I call USCIS to inform them abt the mistake on the Approval Notice? My dates for the India trip are quite tight because of a family emergency.
*** I am not sure what happens to my Green Card? Would they have stopped the card production?
I havent come across a similar scenario in the online forums. Please let me know what my situation mean and if I might still be able to avoid postponing my trip to India

You won't believe this. but this happened to my very close friend couple of days back,When his company filed for his H1extension, USCIS sent 4 resumes of American citizens from his work location area and asked the employer to choose one rather than extending his H1 visa.
If this could happen for H1b extension, this could very well happen for Green card approval also
