I am in similar situation. Our 485 were denied by stating PD was not current when it was filed. But we filed during July fiasco.
Now it is almost 5 months and no update on our MTR :(
Lawyer said they filed MTR also went through AILA but no help.
What to do now? Should go for Infopass/Congressional inquiry?

Hi Boss123, you came on ap without h1 stamping, one question did you leave all papers in consualte and still processing the h1b. by way which consulate did you go for h1b stamping. Did you consult any lawyers as to what happens to h1b process and h1 stamping after you entered using AP.

There is no real need to relocate unless you work for a consulting outfit. There are tons of employers in big cities as well as big companies who lack technical talent AND can easily sponsor H1Bs. Maybe 1 time relocation to that good job may be needed.

Thanks for the replies. What I meant by "not following process" is that new company declined to represent me for my pending I485 process or the attorney's didn't file a G28 on my behalf. They are only doing H1B which is great.
Yes I did change employers thinking AC21 but I haven't sent the AC21 papers to USCIS.

What about your current attorney? Since (s)he has been representing you, you can just stick with him/her, if possible. You don't have to send any communication to the USCIS at this point anyways, just in case of an RFE.

It clearly states on Chennai consulate website that you need 'Original H1' for stamping.

Well no company asks for I-797 (H1B) petition back when one resigns. It is supposed to be with you. You will need it for future to prove your non-immigrant status. For all purposes (driver license, loans, invite your parents, H1B extension, H1B transfer etc & etc....) you will need to produce photo copies of it(Sometimes originals too).

So a new startup would not be able to get GC for their employees but big companies can ?
I beleive Google, LinkedIn, and a whole plethora of firms (now in Fortune 100) were startups with foreign nationals students as their employees.... So you are saying they will not get GC.
But Walmart might be able to get .net and java programmers from China, India and that would be an expediated GC?

I am working in USA since 1999.In 2004 when retrogreesion hit, my two friends went to INDIA with their family and one friend moved to Canada.at present i don't have any friend which i can say that i know him for more then ten years and are waiting for their green card.I simply took a chance and decided to wait for GC.Did i made a good decsion or bad ? i don't know right now.But one thing is sure that as the time passes by i am more impatient, stressed and frustrated.
I suggested to my younger cousins who are in IT not to come to USA.they took my advice and went to Australia and UK and are now very happy and doing great in their jobs.
If US government not take action on this problem then it would not be great for this economy.As said in a very popular phrase "what goes up must come down".India was once called a GOLDEN BIRD and then downfall occured now rising again.UK is also emerging fast now a days as its richest person actually is INDIAN ctizen LAKSHAMI MITTAL.People here in US should realise the potential of legal immigrants otherwise they have to pay the price sooner or later.
(What goes up should come down and vice-versa). Think of retrogression, it is so far down that I can't even see it with my naked eye. This has to come up, and it will this time, you will see something done for us if your theory of up and down is correct.
Trust me ... many people will agree with me that all those who are not in US
badly want to come here. People in canada, india, UK and Australia cannot be as happy as anyone is in this country.

Entering the USA on AP does NOT invalidate a valid H1-B.
H1-B status is lost ONLY IF you work using EAD or you let H1-B expire.
Simple!

Well, if one's situation is destined get messed up it will :mad: Many times non-desi, gora companies and their lawyers can make astounding mistakes that will affect non one but guys/girls like you and me.
You got it right - bottomline is, be it Indian, American, Chinese company, it finally boils down to $$. Companies wont bother you as long as you are billable. Consulting companies will not have problem paying you as long as you are earning. Big companies things might be different, there are hierarchial decisions made, things don't get communicated properly etc.... Small companies may have tax problems etc... No job is stable. And when it comes to dealing with immigration, it is very common that lawyers representing big companies make grave mistakes and at times get commercial or just beurocracy ....

If IBM is laying off a person and does not have a job in USA for that person how can they show they have a job for that person in USA whenever he gets his greencard?
You are correct, I am also in the same page as you are. He has been told, it is not a lay off, it is just a relocation of resources and his future title/responsibilities are different from his current title/responsibilities so he can continue his green card application.

Hi!
I'm a US citizen, a senior consultant who often works as a 1-person company (S-Corp).
My brilliant girlfriend from Bangalore, who works as a IT Project Manager, is arriving (on a 10-year B1 [business visa]) March 27 to stay here (NEW BRUNSWICK, NJ) and build a future with me.
QUESTIONS:
Is the B1 any use in getting an H1-B?
What's the best way for her to get an H1-B? Apply immediately to NJ firms when she arrives on March 27?

If you are a US citizen and if you plan to build a future with her and the best approach is the get K1 visa (for the fiance/fiancee of citizens). its valid for 6 months and its immediate. Then if you marry her, you can apply for her immigration as spouse of US citizen. While her application for greencard is pending, she can get EAD and that would allow her to work.
This is THE BEST route for US citizens who want to plan a future with foriegn born individual. You can talk to an immigration lawyer to confirm this.
Visitors visa is a non-immigrant visa and she is bound to be having "non immigrant intent". If she applies for H1 after coming here, it might run into some scrunity and inquiry. It would cost to reply to that inquiry.
Secondly, if she doesnt get H1, but even gets married during her B1 stay, it would still run into some scrutiny by USCIS as they might think that she had immigration intent all along and circumvented the long immigration process by entering on B1 and adjusting status to H1 etc or getting married.
You need to be careful before planning all these steps and get paid legal advice otherwise you will run into nightmares of epic proportions.

I have file EB1-OR. I am a prof. But I think OR is open for post-doc fellows as well. EB1 requires a lot of documentation - my 140 is pending for about 9 months now. So even EB1 is taking a long time these days.

Last week I received email with RFE on my pending I-485 case.., this was little surprising considering RFE is issued after almost 4 months since I have moved to a new employment in a new location last sep08. LUD got updated after I filed for change of address in Oct08.
When I changed my employment I did not file for AC 21 documentation to USCIS. So far I have not received any mail from USCIS. Do the RFE details go to attorney or to myself. I am planning using the same same attorney who filed my GC to respond to this RFE..
Pls let me know if you any ideas or experiences with RFE's

I would like to suggest that we wait until the first rally is over. We have to see the number of people who attended this one. There is nothing worse than organizing a second rally without a good number of participants.
