Thank for positing information about lame duck session from Mathew Oh's site. However, this is not yet a confirmed report yet. The current situation is that everybody is waiting for a decision on the length of lame duck session. If the leadership (in the congress) decides to do 6 weeks lame duck session, in that case we will get an appropriate vehicle for our provisions. But if the Senate/House leadership decides to do a 2 weeks lame duck session, in that case there would not be any bill.
We have a plan and we are on top of things. Also, please know that with your support, Immigration Voice is also growing stronger and we get more update info. But acting prematurely would not help in anyway. Webfax is a very important component of IV�s efforts. IV (and other like minded organizations) are all keeping our fingers crossed, hoping for a decision for a 6 weeks lame duck session.

I had also emailed the ivcoordinator@gmail.com with my case number.
I have also conveyed the news to my employer, but haven't heard anything from them yet.
Starting from the post office holding my mail to issues at office, there are too many problems that I have to address in 4 or 5 weeks time.
I am thinking of emailing the Consulate office to withdraw my visa application and passport
and enter the US through my AP. I do not think that I can wait in India for 12 weeks or more. Has anybody done this before and would this create any new issue?

Looks like its not going to be covered for Visitors as per the person posted above.
I don't think this bill has anything to do with the medical coverage of visitors... They will have to get a visitors medical insurance just like they do today. Of course you can buy plans that cover the pre-existing conditions to a certain degree or in full provided that you pay for the premiums. Also, I am assuming that when you talk about visitors, you are talking about people who are here on tourist visas or perhaps Business visas...

She's trying to bully you with that start date of July VB.
I'd ask ASAP for a copy of the whole package (which is your right to have) and re-file on my own or find a cheaper lawyer. You can just copy whatever she did and change the check box for previous filing.
$2500 is a rip off ... mine only charged $1000 plus the USCIS fees.

My previous desi employer is not sending me the W2. I don't think he likes me after I left him :)

I had similar problem last year with stupid indian company HEXAWARE. As per attorney's advice, I send couple of emails requesting the W2. No Response from their side.
I sent them a registered letter to their NJ office with return receipt. (Still no response)
I Called IRS and spoke to their customer care and launched a complaint. They said they will call the company and instruct to send my W2.
Guess what!
I got a call from stupid so called "Big shots" in the company with an apology to withdraw the complaint.
They overnight the W2 :)

You an claim your India house as second home(holiday home) and take the deductions for the interest you paid in india.
You should be doing Itemized or you should have expenses more than your standard deductions. In case if you didn't buy house in US, I am not sure whether you can claim deductions for second home(holiday home) without primary home.
You can search for "Tax deductions second home" in IRS website, they have very clear document.

I tried calling them for the last 2 days....monday and tuesday....left voice message and no response
starting yesterday when you call the indian consualte in SF the call goes to the company to which they have outsourced the visa work...but again I believe they are not going to handle OCI and PIO till March...
now looks like I will have to pay again for a PIO as my daughter's OCI is not valid anymore I guess.....:mad:

I spoke to Carol (Badge #Ex547) at Nebraska service center just now. She told me that it take 60 to 90 days before they take my case and it's not yet assigned to an officer. She also told me that you are one among those 500,000 other applicant who applied in that time frame. So, though the Aug,2008 is current for EB2 and RD is under current processing dates, there are lot of application which won't get GCs until another 4 or 5 months (by the time they assign cases to officers etc takes minimum 2 to 3 months even our RD is under current processing dates with Nebraska and PD is current)

USCIS returning the visa back to DOS. What is that mean to us?
That means, the visas are still available for the month of July-2007. That means they have to accept our application.

It's good that they are cracking down on the employers who are exploiting the H1B program but it's sad that some genuine people are getting affected by this. US govt should allow the businesses to flourish and it's not goog to point fingers at H1B/Outsourcing all together for the job loss as if these policy makers have no contribution for this economy crisis.

Have I140 approved with PD of 12/05.
Got a 3 year extension upto 4/2010.
Am a little tired of my current job and started interviewing before the recent jump in PD, and the CIR mess.
Not sure how exactly to react to these recent events if I get an interesting offer. The biggest thing is I am not sure I would be able to port my PD (based on approved I140) if the CIR gets passed.
Guess I need to wait and watch how CIR and PD motion progresses over the next month or two.

Which "law" quoted the words "AT ALL TIMES" ?
From my readings "law" is very vague on this part. The closest interpretation was on the USCIS memo dated 2005/dec/27, which states "The alien cannot still be looking for �same or similar� employment at the time the I-485 is being adjudicated under the adjustment portability provisions. The alien must be able to show there is a new valid offer of employment at the time the I-485 is adjudicated."
But still it doesn't interpret as "AT ALL TIMES" (without a gap).
All USCIS ask is the "current" offer of employment.
So
1. You should have a legitimate offer at the time of 485 application
2. You should have a legitimate offer at the time of adjudication/RFE.
(obviously same/similar & permanent)
That's all the current interpretations are.
I have no question that you risk your GC any period you are un-employed, since they can ask for EVL at any time.
But that is different than a "legal requirement" to be employed (or having an offer) "at all times" (no gap).
Having a period of unemployment have no effect on your pending 485, as long as you have a legitimate offer at the time of RFE.
I-485 applicant (employment based) MUST have permanent job offer AT ALL TIMES until I-485 is approved.
This could be unfair to the I-485 applicant, but that's the law.

3 - An audited financial statement of 2007
Try to obtain the audited financial statements from prior years, if you can't get it, attach a copy of employer's tax return. The ability of pay is determined at the time labor was filed or job was offered, current financial statements might not be as valuable as the old ones when the labor was actually applied.
I can't get the audited statement of previous years, but I have the tax returns but they are not good, I have send them already when I filed the RFE.
