    The Only thing that you need from NEW employer is a "Future Employment Letter" quoting that they will continue to have you after you get GC( that letter should quote ur Job duties and pay and those should be in synch with your original GC labor app) . Otherwise after 140 approval and 485 rotting for 6months+ you should be good.

    Regarding 485 RFE there are the following options :-

    a) Change the representation of your case by having an independent Lawyer filing a new G28 with USCIS ( whom you have hired now)

    b) Inform USCIS that you are revoking the current representation and there is no lawyer moving forward - You will yourself reply to RFE's (I'm doing that)

    c) Bother you new employer to have their Lawyer file a new G28 and answer all RFE's moving forward.

    Thanks for the wealth of information being shared. I am in a slight pickle. My I-140 has been approved and it has been more than 180 days since my I-485 was filed. I am in the process of transferring my H-1 to a new company. However, in the offer letter there is no mention of the fact that the new company will support my green card application. In fact i was focusing on the fact that i need my H-1 transferred that it just skipped my mind that i need to get at least a verbal confirmation that they will support my green card application.

    Now for my question(s):

    1) Once the I-140 has been approved and it has been more that 180 days since the I-485 app has been filed, is there anything the new company has to do, green card wise? (I don't think the company set out with the idea of doing even an H-1 transfer. Though I've convinced them that i need to transfer over my H-1, I'm not sure if my request to support the green card process will fly)

    2) My current company pays for all H-1 and green card related expenses. My new company is doing the H-1 transfer but has mentioned that i have to pay for EAD,AP renewals. Other than EAD/AP renewals are there any other expenses i need to keep in mind at this stage (lawyer fees for corresponding with USCIS? lawyer fees for responding to any RFEs maybe?)?

    be careful with how you use your W2. That is a sensitive document containing a lot of information. Pls think of something more sensible than asking people to send their W2 forms. There could be other ways to communicate the tax contribution (if that is what you intend) of legal immigrants. Also, please note that even if you are not given a GC, the IRS will still recieve your tax, right? they already know that we pay tax (actually not pay... its collected before we get our pay). Now they are trying desperately to find out legal immigrants who are not being paid and cancel their visas.

    Thomas ....hmm More sensible like sending calculators, Pizza Yeah makes sense there ....Make them fatter and lethargic so they sleep more than they already do .

    W2 might be radical step ....but that is what will get the media's attention ...not Pizza and Calculators ..

    W2 is sensitive .....true .......but tell me how can your W2 be misused ? If you have yr ssn on it you can blank that out .....(If you think that USCIS will "misuse" it )

    Why is an amendment required if you are using portability? And if an amendment is required anyway, what is the advantage of using portability - cant I just amend my H1 and be done?

    Any other thoughts, please?

    I received a RFE regarding medical test because the Civil Surgeon didn't complete some of the forms properly. I replied bak to the RFE few days after I received it (within the allowed time).
    my question is how many days does it take USCIS on average to look at my reply to the RFE and make a decision on my I-485 application (my PD is current as of June VB and been current for months now)

    if USCIS does not make a decision and if PD retrogresses in July VB and I won't be current, does that mean that USCIS won't make a decision then untill my PD is current again???

    I also got an RFE on medical. The stupid doctor marked "TB skin test not done" !@%$@% . RFE was responded. There were two LUDs after they received RFE ( last Friday , the latest one ) . If i am lucky , i might get approved next week.

    I had a infopass appointment at Newark today. I was told that I need to wait till Oct 1st for visa. Thought, I might share with people.

    Did you not ask them if there were no visas for this fiscal year, how come Sept Bulletin is showing availability. Did they tell you anything about the so called latest memo about visa numbers being exhausted.

    Parents and Spouse of a US citizen dont need visa numbers from family based quota.
    And the funny part, there is a quota of 226,000 on how many Family based GC are allowed into the country. If the right category is applied, people get GC's in 1-2 yrs.

    secondly, thank you everyone for the information! this helps a tremendous amount. I've schedule an appointment tomorrow to talk to a USCIS representative, thanks for that advise. I'll save the rest of my questions for them :D

    I found this forum looking for info on the shots and check up that is required for the green card process...does anyone have any further input on it? Is/can this be covered by insurance? I know the cost is about $700. Do we have to go thru the selected doctors that USCIS give us?

    Assuming no bill passes, ur PD should be current in 1.5 to 2 years. ( just My guess )

    Any kind of Labor and I-140 process will take 1.5 years assuming no audit + $5K in attorney expense.

    May not be good choice..

    Skill bill will increase H1 and GC so much that next 10 years most of the people will get GC in 6 months to 2 years.

    Not to criticize you, but every year there are thousands of students coming from India to the US. Although their numbers have dropped slightly for the first time in 2006, they are still enormous (60K+ every yr). Getting a GC in 6 months even after Skil is passed does not seem likely. When the bill will pass, it will reduce hardships not eliminate them.

    The number of students who come here is not controlled by the number of GCs, unlike that of people who come here on H1B.

    There are many reasons for this unprecedented rise in the number of students coming from India in the last 5 years. Undergrad enrollment has been falling in many engineering departments. Hence grad admission standards have been relaxed, and international students are being welcomed. Plus, in the post-cold-war era, the US consulate does not deny visas the way it used to in the nineties. If you did not have financial aid from a univ then, it was difficult to get a visa. Also, kids in India these days get $10K loans from banks! So coming here is no longer difficult. So as I see it from a univ setting, the number of Indians applying for GCs will continue to be very high for the foreseeable future (10 yrs?). But hopefully, those with PDs until 2006 should see their GCs in 2-3 yrs after the bill is passed. We can't worry about all of the people who are coming now....

    Hi All

    looks like my struggle for immigration is never ending. My lawyer shipped my app on July 30 and even as of today USPS track and confirm displays second attempt was made on July 31, and package will be held for five days. This put me in very worrying situation.

    So I called USPS and they gave me local phone number for Mesquite office
    972 288 4477. I called them today and talked they are saying that all the packages are delivered. I am not sure what to trust and what not to. I am not sure if my application is delivered or not though person at Mequite office told me so. Because USPS online status still says the second attempt was made on July 31 and then no update. If there is any way to contact USCIS and find out if they received the application or not.

    Guys who are in the same situation as me please update your experienc. Alsso I have added phone number for Mequite office here, if somebody in my situation want to contact them.

    I just looked at my forms, I-140 is signed only by your employer. There's no place for us to sign.

    If you are EB2 ROW then you can file I-485 but if not you'll have to wait till your priority date is current.

    Getting the copy from USCIS is not all that time consuming. Start by filing your PERM through your new company. It takes 3-4 months for it to get approved. Most probably by that time you will get the copy from USCIS. Even if you don't get it, go ahead and file an I-140. You can always port the PD later.

    Another option might be to offer your old company some money like say $1000 for a copy of the I-140. Depending on how acrimonious your departure was, they might accept it or they might not.


    Yeah! I am going to do that.Also my company is going to file for perm probably in next week.
    The thing is if I am not sure how much he will ask for. If he asks too much I am not sure wheather I should give that much money. Because if the CIR passes then even if my PD is old ,still my new LC will be invalid with this new company.(Because of 15'th may deadline). So paying too much money might be like playing a lottery. Chances are I might loose. Am I correct?
    Also with that form I never seen a single person said "he successfully ported the PD" . But still I will give a TRY.
