The officers should be back from vacation. They would like to stay busy during this recession time and so will be ready to work longer :)
Dates for India moves forward only when they start giving the left overs from other countries. Seems like they do this only during the last few months of the year. So i feel significant changes may not be expected until July.

By the way, a naive question from me(asked by someone to me and no correct answer from me).
"If husband and spouse have separate H, separate approved I140s from diff companies with diff priority dates (of course), can they file 485 separately and add the other spouse as beneficiary? I have been seeing statements that there can be just one 485 app"

My first green card application ended up with the backlog elimination center. Once it was approved, I filed for I-140. After a while my PD became current and I filed for I-485. After a few weeks, my I-140 was denied. (It was in EB-3, I have a 3 year degree but NSC didn't accept it as being foreign equivalent to a US Degree). I appealed and the case was sent to the AAO someine in October 2007.
At that time I was enrolled in a Master's program. I had already finished my Bachelor. So I filed a new PERM, which was approved and then filed another I-140 in EB3 which was just approved. Obviously, the PD for this one is much later: something like December 2
Ok. Now I am flabbergasted.
A few days AFTER the approval of my second I-140, I noticed a soft LUD on the approved I-140 as well as the pending I-485 and a previously approved AP. I called USCIS and asked them to provide me with the receipt number of the I-140 underlying my pending I-485. The number given to me was that of the approved I-140 that was filed later!
I was so shocked that I called them again after a few days to make sure that I was not imagining things and got the same response: USCIS is telling me that my pending I-485 is linked with my approved I-140.
How is this possible? My understanding is that interfiling is allowed only if the I-140 underlying the I-485 is approved. Do I have an incorrect understanding of "interfiling"?
The only thing I can come up with is that in my case, both I-140 were in EB-3 and were from the same employer. Also an appeal for the previous I-140 was pending at AAO so technically it was still pending. In such a situation, I guess the USCIS links the first I-140 that gets approved to the I-485? But since my I-485 has been pending since October 2007, I guess I am entitled to use AC-21. correct?

I don't think you can use the experience in the same company and position to qualify for EB2.
Also if you are from India how does it help as even EB2 is retrogressed.
You get promotion and salary hike without having to start again.

Recently I had a big fight with attorney on this issue. I just asked her for copies of my L/C, they provided me copy of 140 approval but not labor. She argued that employer owns it and she cannot release, I was pissed because I sent the checks for the labor petition, whereas my 140 money was paid by employer (Deducting from my per diem). I had to exchange extreme rough emails and literally burn the bridge and finally employer asked her to give me the copy and she did, now she is applying for my h1b extension and does not talk to me anymore (poor me :) :) ), but interacts with me only if needed.
When I was dealing with USABAL, in my previous company, I got into a heated email exchange with a paralegal, and finally attorney interfered and gave me the copies, after that incident, that paralegal would definitely not take my case ( again poor meee :) :) )
Its fun to deal with these pimps, my dad calls them "Liars" and not "Lawyers".
Unfortunately I am also dealing with the same attorneys :( Luckly my company is willing to provide me the copy and I got it from them. Who the hell are these attorneys to come in between me and my employer and confuse them with these innovative unwritten rules, even when the employer is willing to provide us. This is what I do not understand and would like to question their morale and ethical responsibility. I hope they will be exposed of their wrong doings and pay the price as well.

Spouse living in a different state...how far..me on the west coast, she on the east coast. Making matters worse, our primary residence (what we call home - our house) is in a 3rd state.
What we do? Meet up at the primary residence every long weekend. We only get to meet 8-10 times a year...once every 1.5 months or so...

Hi All,
My EAD is about to expire in 120 days and i am applying for a renewal by e-filing it.
I am confused by the question #17 i think about what is your current immigration status?
I am currently on my EAD and my I-485 is pending. What should i put my current status as? (i entered using my H1-B but that has expired)
There is no option in e-file which says payrolee(AOS pending)
Here are the options i need to choose from
DA:Advance parole(district auth)
PAR:parolee
DT:parolee(district/POE auth)
DE:parolee(deferred inspection)
Can someone who has e-filed answer...

aMy H1 and wife's H4 is up for renewal this Nov. Ours will be the second 3 year extension of total 6 years. I have some queries:
1) As our I-94 will get expired in Nov and we do not receive approval (but if we have the receipt) before Nov, do we have to leave the country?

2) We applied 485 in Aug. So do we get 3 yrs of extension or 1 yr? Because I heard that after you apply for 485, we get only 1 yr.
