Hi shana04,
Thanks for your immediate reply,
I got the employer letter.
EVL does not have
1. Does not specify my skillset
2. It contains a Statement " Company A (like most employers) is an at-will employer and therfore does not guarantee to continue any employee's employment(my name) for any definite period of time. At this point, Company anticipates that <name> will continue to be employed as <Designation> on full-time basis.
3. does not say any thing about RFE content.
"the letter must also indicate whether the terms and conditions of your employment-based visa petition contine to exist."
Please let me know what i need to do.

Could you please elaborate on this. If I buy business, of course the loan will be in my name but just like buying a house, the bank will have lien on my property which will include the business itself as well as my personal property. Will this qualify so long as the loan is in my name?
Raising money thru legal domestic and foreign sources for investing in EB-5 category is allowed as long as the loan is not secured by the business itself. Money you raise must be secured by your personal property.

Does that 1 year time period start counting after the GC has been received? What If I have already been working for the employer for over 3 years...can i change my job in the same month as I got my GC approved?
Every attorney's opinion that I have read says the period is after you get the GC.
Has there been any case ever where an applicant was denied citizenship only because the applicant left the employer within a certain time of 485 approval? I haven't any such case.
I haven't heard of any (but then my circle of friends include people who are very cautious about these things).
The bottom line with AC21 and having worked X years before getting GC is that you have to see if you are confident of convincing USCIS or an immigration judge that you had acted in good faith and your intent to change came sometime after GC (again I dont know how AC21 can be included in all of this).
Then again, you have to worry about this only if USCIS ever wants to follow up (unless you were involved in some illegal GC scheme, I believe USCIS has better things to do).

Here's what happened with me:
My wife left for UK and the very next day i got a fingerprinting appointment notice for both of us. The form is just like a I797 Notice of Action document. It has your alien #, reciept #, name address and such details. On the form is also your appointment date, time, ASC (Application Service Center) where you should be going for your appointment and a BOX to check if you want to re-schedule.
So anyways, to re-scheduled my wife's appointment, I wrote a cover letter, attached the original fingerprinting notice with the BOX checked and a copy of her driver's license and sent it to the address mentioned on the form.
Three things:
1) My lawyer advised me to get my wife's signature on the cover letter. So I e-mailed it to her and had her fax it back to me.
2) I made a copy of all documents that I sent to the ASC.
3) I sent it by USPS registered express post, making sure I could track it and it reached ther within two days.
So, I went ahead with my appointment as I had no reason to re-schedule mine. On the day of my appointment, I showed them the copy of my wife's documents that i had mailed and confirmed that they have recieved it.
Rest all went fine, got a new appointment date for right when i wanted it, (I don't think you can ask for a particular date, but I tried for a date after such and such date and it worked).
She went to her new appointment schedule and everything went as planned.
No worries, Its not a big thing, just make sure you can get a cover letter signed by her so things go as smooth as possible.
Hope this helps.

Part 3: 1. 09/01/2008; 2. 4 weeks
Part 4: Part 3 has a line that says "If you are applying for an Advance Parole Document, skip to Part 7.". So, no need to fill-up Part 4,5,6.
Part 7: Select "More than one trip" as this should give you a multiple-entry AP.
Good luck!

My Opinion :
EB2 -Range December 03 - March 2004
EB3 - Range November 2001 -February 2002
based on historic movements but then this is USCIS

From the communication available thus far from various websites, it is expected that USCIS may decide to accept "some" application filed in early july.. "Some" is the key here. There may be hundreds of thousands who are ready with their stack of paperwork but did not file since the fiasco started. The anticipation was (sorry.. "is") for a permanent solution. Accepting "some" applications is definitely not a permanent and a longer term solution.
Like other I am also expecting for some real permanent solution. Keeping my fingers crossed.
Friday came and went past, Saturday passed off silently, Sunday still thinking what will happen tomorrow.
Let us hope Monday will be a good news for all Legal immigrants and our problems of PD fiasco will be solved.
Temporary or Permanent hope it will be good news to everyone :-)

Sometime I feel Newark office are not helpful a lot. What was yourexperience at Mt Laurel? I might go down there.
Had an Infopass nearby at the Mt laurel, NJ office and was told Visa numbers are still available and should be available till early next month. Don't ask me on what basis. Just communicating what I heard

Both together is no problem.
Both need to sign.
Increased amount shows higher guarantee and two people sharing the load. 'Had also sent in a private message to share my (similar) experience.

Are you a physician? Judging by the acerbic tone of your reply and the fact that you think any one who should try to take charge of their own health is a "moron", I think you are a physician.
Let me point out a few facts for you:
1. American institute of Medicine report in 1999 estimated around 50,000 to 100,000 people die due to medical mistakes in the hospitals every year.
Heres a summary of the report http://www.iom.edu/~/media/Files/Report%20Files/1999/To-Err-is-Human/To%20Err%20is%20Human%201999%20%20report%20brief.a shx
2. Article in one leading american journal " Journal of American Medical association, JAMA" estimated
12,000 deaths/year from unnecessary surgery
7000 deaths/year from medication errors in hospitals
20,000 deaths/year from other errors in hospitals
80,000 deaths/year from nosocomial infections in hospitals
106,000 deaths/year from nonerror, adverse effects of medications
These total to 225,000 deaths per year.
These are only 'DEATHS" in the hospital. It doesnt include disability and other injuries which occur out side the hospitals in physicians offices. To put it into perspective, this is more than the deaths caused by lung cancer and breast cancer combined!!!!!
If you want to see this article it is in JAMA year 2000, issue 284 on page 483.
These numbers are real and not cooked up by me.
So just because a person has an American medical license that doesnt mean he is an expert on your health. From the data above, this person may actually KILL YOU!!!!!
You should do what ever you can to stay healthy and to try avoiding doctors and hospitals. All this bulls shit about annual doctors visit and physical exam is crap. They will do bunch of blood tests and if some thing comes "abnormal" they will do another bunch of tests to "confirm". Then they will send you for xrays. ultrasounds etc etc . Then when they cant figure out what that "abnormal" means, they will tell you to keep following with them every few months so they can keep an eye on it. Or they will send you to a specialist who will do another round of tests!!!! I mean its all messed up. I can kind of see the doctors point of view, they are afraid if they miss some thing , they might get sued. But ultimately, its not benificial and it doesnt improve your health!

Hello everyone,
I just was about to be relieved thinking that my lawyer mailed the I-140/I-485 package yesterday. Its not over yet.. hmm.. Today I check the Express Mail USPS tracking system and it says the following
Notice Left, July 26, 2007, 11:50 am, MESQUITE, TX 75149
Arrival at Unit, July 26, 2007, 9:22 am, MESQUITE, TX 75149
Enroute, July 26, 2007, 3:17 am, DALLAS, TX 75260
Enroute, July 25, 2007, 7:42 pm, HOUSTON, TX 77205
Acceptance, July 25, 2007, 4:15 pm, HOUSTON, TX 77074
Why would USCIS not accept my packing by 11:50 AM on a Thursday. This is getting me worried.
The application will surely have to be accepted tomorrow (Friday) else I will be in a big soup. Tomorrow is the last receipt date wherein you can pay the old I-140 fees. Starting Monday (30th July 07), the new fees get into effect for I-140 filing.
Did anyone have similar experience?? Please give your feedback.
Not sure whats going on but hopefully uscis rep will pick up all the usps mails from the postoffice in the afternoon.

Honest attorneys ? They don't exist !
By law, a foreign national can work in US for any amount of time in H1B. He/she doesn't need a GC. GC is always a perk to the employee not a requirement by labor laws. If the attorney is that honest, he will stop filing all labors including EB2 and EB3 as well.
This attorney is just protecting your employer's interest.
I think you have some wrong information. A foreign national can work in US in H1B for a maximum of 6 years at a stretch. After completion of 6 years of stay, they have to go out of US for atleast 1 year and then have an employer apply for a 'NEW' H1B.
The only way that a person can stay beyond 6 years on H1B is if their GC (I140) is applied atleast 1 year before the completion of 6 years or has an approved I140.
