I really wish that Congress falls just short enough to require the support of Left.
Left has an important role to play in Indian polity. Without them the weaker sections may be left orphaned.

I have a friend who had got his green card 2.5 yrs ago and his pd was oct2003.
I know a few EB3-I folks with PD in 2004 who got their GC in July-2007 when dates were current.
How can they go back this far !!

Meaning, if they have certified only 50,000 cases, then they have denied over 58,000 cases so far...more than 50% denial rate? That does not sound right.
A couple possibilities:
(a) after the tech wreck a lot of foreign workers were also laid off -- so that their employers probably didn't reply to 45 day letters. Not replying to a 45 day letter would go into the "completed" category.
(b) If they got to the 245(i) cases, it is possible that a lot of them didn't stand up to scrutiny.

Guys, we have to do something.
Don't rely on IV to do anything for EB3-I. Most of IV core are EB2 and they are already benefited by this spillover changes.

Hi,
I'm E-filing my ead newal. My status is
I'm on H1B with wife being on H4. We both are July'07 filers and received EAD and AP last year.
We both went to India and used AP's while we came back as we had no Visa stampings on our passports. After returned to US, I'm back on H1 and never used EAD.
Our H visas will expire on 07/30.
While filling the I-765 application, I thought we both should put in 'PAROLEE-PAR' for Question(14) 'Manner of Last entry' AND H1(or H4) for Question(15) 'Current immigration status'.
My attorney mentioned that I should chose PAROLEE-PAR for both questions as we didn't file for H extensions after returned to US using AP. Is this right.

No you cannot do that. Your address is used for the security check. you cannot give your employer's address.
Also, FP notice usually comes in a week or two of your notice date but these days you never know. Receipt itself is taking more than a month.

Your I-797 expiration date is of no importance in this case. When I was in my first year of H1, I had to change employers- and my new employer successfully filed a new I-797 even though my previous I-797 had more than 2 years left for expiration.

Lot of H1B have already paid taxes in to Social Security
We add Billions of $ to Social security kitty but we would'nt get any thing unless u turn 55 or 65 but by that time, the Kitty is bankrupt
Also lot of H1 left US for ever for several reasons and the Kitty did'nt pay back Social Security.
UK does return social security taxes if u leave UK for ever (But there are conditions for it).

There may be a chance for H1 extension in this situation if I-140 is not revoked.
But I do not really see how such extension can be granted.
Extension beyond 6 years has to be based on:
- LCA pending 365 or more days
- I-140 pending 365 or more days
- Approved I-140 and an alien is not able to file to adjust status to U.S. permanent legal residence based on the unavailability of an immigrant visa number. (I do not think it's applicable here as approved I-140 cannot be a basis for I-485 filed with a different employer).
But I do not really see how such extension can be granted.

Couldn't it mean exactly opposite of it??? I think they are very much into talks/negotiations. and I guess our IV guy's source of information is one of their member only; thats why they are more optimistic leaking this information much earlier than actual negotiators AILA.
But anyways, it looks like that everybody is working what they can!!!! So hope for best....

There certainly should be an office for International Students as well as Asian/Indian orgs.
The office for international students deals with immigration matters and will not like to put an ad. I am quite sure of that. But the Asian students orgs may want to. I will ask them. But on second thoughts, should we be concerned with people who are coming to the US now? I think we should be concerned with those who are into their H1Bs already. They are more likely to want to become members.

I did not see anywhere that color copies of any document (except color photos) is a must, and will send standard B/W photocopies.
I have another question: There seems to be some confusion about the "Date" (of application of last EAD) that one should write on the form. Someone on this forum said he made a mistake (http://immigrationvoice.org/forum/showthread.php?t=18886) (3rd entry in this thread) by putting the receipt date, which in my case will be July 2, '07 (yes, I am a July 2 filer). If this is indeed a mistake, what should we write instead? Is it the receipt notice date (Aug 27, '07)? Anyone knows about this?
Also, paper filing apparently avoids getting another FP. But, like so many others, I never got the notice for my first FP, even after 10 months. Hopefully this will not complicate the renewal. Anyone here in this boat?

Let us see how many are willing to contribute after filing 485. Even then people will say they are short of funds even $100 because they have filed 485 and spent everything on attorney. All these days they were cribbing that nothing have been achieved, now they will say that it is not because of IV. Some will say, now filing 485 is not enough for me, I have to get EAD and use AC21 portability so that I could earn more and then I will THINK to contribute. If they use AC21 then they will say, I want my spouse to work on EAD so that I will be financially sound to contribute to IV and it goes on and they will never contribute for ever.

I did not know that if my spouse wants to work on EAD then I have to invoke EAD and can not continue on H1. So it seems wiser for spouse to work on H1 than EAD....of course all strings attached to H1 come with that.
