Per my understanding once you have filed your I485, you can file EAD and AP later any time. PDS need not be current for that. So I do not see any good news in it.

please find the attached pdf which talks about arriving aliens and I-485 - It is from AILF. I don't know the full extent of your wife's case so, this is the doc I can find based on your posts.
Also, can you please tell me the following:
1. Is her I-130 approved?
2. When she was paroled into the U.S, was she given an I-94 and what was the date on that?

Is staying in a hotel or a rented apartment counted towards stay in canada ?
Are you asked to show proof of the stay like rent rceipt or hotel bill ?

When you renew your PR visa after 5 years they will check for physical presence in Canada. You need to show proof ....emplyer payslip or
something else. ON teh whole you need to show you staye din Canada for 2 years.
The passport entry stamps can be used to record dates of entry to canada
and US. With that they can calculate how long u stayed in Canada
The old rules didnt require physical presence. New rules ask for physical presence test

All CA/CPA folks,
My wife is a CA with about 5 years indian (internal audit) experience?
We have recently filed her EAD.
My question is can she take up a job first and then study/pass CPA exams or pass CPA exams and then search for Job?

Most employers in USA do not understand / recognize CA (unfortunatly) unless she had big 4 experience in India, so it will be difficult to find a job. In that respect if she would have complete her CPA first, then that will help the resume look good and would give her good chance.
Don't take me wrong, as this is mine and so many of my friend's first hand experience. Its different for non-IT folks, when it comes to Indian education and experience.
If you are in NY / NJ area, let me know as I may be able to help in finding a job. I am CA + CPA and currently working with a large national CPA firm.

None of the employer would ask you to return the I-797. In future, when you go for stamping the IO might ask for the docs. You know...when you have all the documents they wont ask but if you dont have then they will ask. Its just bad luck. To be safe you keep I-797. There is no obligation to return it as far as I know.

Neither have i posted about my contributions. The main point is whether one can appreciate the fact that someone (out of their own choice) has created an infrastructure for us to help our own cause through minor contributions. This organization is not for selling services or products.
Get an idea of how many webfaxes have been sent and how many people are signed up for recurring contributions. I don't think i will be too much off the mark, but would be happy to be corrected.
It's actually amusing to see, in the same thread, a graceful gesture from an administrator (willful, unpaid contributor) who apologizes (when none was needed) for the site being down, and another who wants to see results before contributing towards one's own independence.
I usually try not to clog up the threads but I would like to put on a record that this statement is a sweeping generalization. There are many people who are contributing/emailing/faxing/calling the senate offices but not posting about it, myself included. So, a few bad apples do not mean that 11,000 members have sipped tea and coffee.

We can confer OCI status to those who dont have roots in India but those who have better roots with India, we don't care as much :)

an Indian's kid cannot get OCI..
does this mean that once I become a US citizen (if I were to) then my kids and I can get OCI...
BTW...looks like our desi babus are outsourcing thier work....and trhere is one month of time during which u cannot apply...either with them or with the new outsourcing partner...
I am trying to reach them today and not even the automated system at the indian counsulate id answering....looks like babu chai pene gaya hein (look:mad:s like the officer is on tea break -:)
Also, like Project_A said for new passport looks like you need to re-issue the OCI (see attached from the outsourcing partner website...oops not sure why I do not see option to attach a screnshot...anwyas...saw this on the partner website https://indiavisa.travisaoutsourcing.com/oci/homepage)....this green card issue dragging was not enough....now v have issues with getting OCI for our kids.....

If you read Ron Gotcher's forums you know that CIS is not processing enough cases to use up the annual quota -- yet freaking AGAIN. Which means they will throw away EB greencards yet again, even as the backlog grows and they keep certain countries retrogressed beyond reason.
If they need to use overtime, they should start doing so NOW and not wait for the last month of the last fiscal quarter (July-Sept). We are about to start the third quarter of the fiscal year (Apr-June).
It might also be the case that they are reallocating staff to process the citizenship backlog.
Especially if you live in the Bay Area -- please take a moment to call Congresswoman Zoe Lofgren chair of the House Subcommittee on Immigration to express your concern. Her intervention was critical during the July 2007 fiasco, and this time we should ask her and the subcommittee to act early instead of waiting till disaster happens again. Remember also that as the election approaches (Nov) it will be very hard to get any one to act on our behalf.
I just called both her district office and her DC office. Both were very receptive. As usual greater numbers have a greater impact.

I am screwed, its almost one month and I have not recieved my new passport, I have my gmat exam in Dec and I can't cancel or postpone it. I need passport for GMAT.
I got hold of passport services after dialing multiple times, the answer I got is its waiting for some stupid bureaucrat to approve in Hyderabad.
one of my friend was denied passport renewal here with response that he was issued passport 10 years back with out police clearance and they are questioning how he managed to get it.

That was not good. There is no reason for anyone for doing that. Actually, I had good experience with on two separate occassions. That was how I got my receipt numbers. Mine was delivered on June 15th and the receipt number was generated on July 12. I called on July 16. I have not received that in mail. I am hoping to get that in email this week. I am sure you will receive yours this week.
In any case, call back and am sure (with luck) you will get a nice person to talk to.
Just curious - If it was delievered on June 15th but the Receipt date is July, 12th, doesn't it mean that they will treat your application per the July Visa bulletin and not per the June Visa bulletin?

I am currently in Chennai on a business trip. I am narrating an incident which happend in front of my eyes yesterday.
One of my neighbour's car was parked in the street. A rash motorcycle guy slammed it in the rear. Totally his fault. Car owner question him for his reckless driving. He ran away cameback with 5 guys ( all political ). By this time, cops arrived as well. Those 5 guys uttered these words infront of the cops and everybody.
" Do you know who i am. I am in politics. I will wipe you all".
After he left, people asked cops why they were quiet. Cops said, they were scared for their lives

I am not in the Bay Area. My H1B has been revoked not the I140. I too understand that USCIS would have done that after 5-6 months but was surprised to get a note from them so early. I have a FT offer and couple more in the pipeline, just to be safe.
Now that USCIS has started cancelling and have given a 30 day period when they would have an answer for me, if that precedes the H1B applied for by my new employer, what will be my consequences? This is my biggest concern.
My new company's start date is 15th when it will be 19 days from USCIS's notice. I understand that it is quite possible that they make a RFE while processing the H1B. Will I be able to continue working if that happens?
I will keep posted on my status. Please keep posting your understanding of my situation and how things will proceed.
I hope I am not making a mistake taking up a FT position again. These days it is really difficult to get a consulting company to hire without a job.

but won't the unused EB1 numbers roll into EB2 ? remember, each of EB1, EB2 and EB3 are at 28.6% of country quota (7.1% each for EB4 and EB5). there are never enough guys to fill EB1, so EB2 benefits from it.
