I did invoke AC 21 before my GC was approved, but I am not sure if my AC 21 request was updated by USCIS, FYI... I notified USCIS about 3 months before my approval. wondering if you received any RFE for EVL before your GC approval or else just got approved. Did the officer who interviewed you for your citizenship asked about your job change specifically? Appreciate your response

No, I didn't receive any RFE, I submitted new employer letter along with cover letter when I changed my job using AC-21. I got straight approval after 11 months of sending letter without RFE.

Get some results before asking for money. If this is all about money, I will not pay a single dime to this. Don't discourage people to join the movement. Myself and group of people wanted to contribute but statements like this make us fear that this is all about money and no representation.

Hello,
Can someone help me with this question?
My wife has worked in the USA on L1 & H1 for 3 years. She then took a 3 year break due to the kids and is planning to go to work coming september or october. I don't have a green card yet so she has to get a H1 to work. We'll be applying for change of status from H4 to H1 but i wanted to know if her H1 counts in the H1-B 65K cap.

No..I dont think so she will be subjected to the cap as I know my friend who was on H1 for 3yrs..went back to H4...but totally the H status was less than 6 yrs, so she dint have to wait for the quota, she got her H1 on the 5th yr of H4..that is in Dec 06..
Only if the person has crossed 6yrs on H status will fall into the new H1 quota...

Hello,
Today I was diagnosed with rare form of cancer which will require 6+ Month of in-patient treatment (Chronic myelogenous leukemia (CML) for the curious minds). My question is can I take leave of absence or should I apply for different catagory of visa? If I have to quit, will my insurance company still cover me?

I am on H4 and my husband's company has files H1-B visa for me in 2007 quota. Will this file considered as H4 to H1 Change of Status case or fresh H1-B case?
And normally how long time its takes to get approval for H1-B? My company files H1-B for me in April so when (around) can I expect H1-B approval?

My attorney said AC21 is not mandatory, If you wish to submit or not submit that is OK. I asked him what would you suggest, He will not go for AC21.

Not sure what you're saying here Ronnie. Lifestyle and social security are quite good in the UK. You get more leave, a more egalitarian system generally, more "free" social services etc in you homeland. If that is your objective, then I can't see your intent in immigrating here :):):)

That said, I do feel that a large percentage of those coming to America from the UK are doing so on the basis of lifestyle. There are some great things about living in the UK, but my word, it is getting insanely expensive to live here. And its COLD!

If I am able to port my old EB3 PD to new I-140.
Do I have to file another I-485 or I can inform USCIS of new I-140?

you should file all the paperwork and forms anew. think of your EB2 processing as a completely separate way to get a greencard with some icing in form of an older PD :)

I'm working with the same employer for the past 4 1/2 years. My six year H1 is getting expiring on 02/2009 and having B.Tech & MS from Indian University with 13 years of toal experience (8 years in India and 5 years in US). Can my employer apply PERM Labor in EB2 even if my EB3 I-140 still pending from NSC by retaining the same PD of EB3?. Is there any possibility of applying directly one more I-140 in EB2 without applying PERM and not affecting my EB3 I-140 process?. One more thing am I eligible for premium I-140 for EB2. Bottom line can I apply EB2 by retaining the same PD of EB3 by taking advantage of I-140 Premium processing.
Please advice me.

The NY consulate received my passport on Jun 6 2008 and I got my passport back on Jun 21 2008 through US Express mail. I tried to call in between but none of my phone calls or email were answered. I looked up one of the consul generals online and directly called him and got my passport info with tracking number. He was very nice, polite and helpful. I recommend you using express mail because its got a tracking number and you know when and where your passport is. Good luck!

My EAD renewal has not been approved and it has been 100 days. I checked with local immigration officer and they dont know as why it is still not processed. USCIS customer service representative says it is within the processing time in Nebraska service center. I efiled EAD and got the biometrics done in June. I am on EAD & can i continue to work if the EAD renewal does not come through befire the current EAD expires ?. Will it affect I485 ?

So no one is for us other than ourselves. If you are lucky, you will get it otherwise you are stuck. I know several lucky and unlucky stories. Just for example when I was working hard as a consultant in 2000, a guy was sitting in bench from day one he came to US for more than a year. Though he is skilled and smart, the company he came from gave him trouble. After nearly two years in bench and when he decided to go back, luck knocked at this door with pre-approved labor from big firm. He took it and got his GC within 6 months and now he is about to get his citizenship and I am still talking about 485 and waiting for 140 approval.

What are planning now that you have your green card ? How has it improved your lot personally and professionally ? How do you plan on capitalizing on your green card (apart from the fact that you can take up fulltime opportunities) ? For the sake of heavens, please don't mention how you plan on incorporating and file H1B visas. I have nothing personal against incorporating, I am incorporating myself to be able to do corp-to-corp contracts.
Coming down to me, I have a masters in comp eng from an approximately 50 ranked college, as ranked by usnews.com. I also have six years of supporting infrastructure environments. I have solid references at linkedin.com. I have coded at topcoder.com but my rating is in the bottom 10% as I lacked the will to spend time and energy. I really like to work for a startup in California. I recently failed a written interview with a startup with a few founders of Indian descent. I will continue looking. I am also looking for better paying SOA contracts. Personally, I want to spend more time meditating and connect to God. I believe each thought affects the whole world. I believe in Karma. At work I fix issues which no one has brought up which I wouldn't have a few years ago. I am at a point in life where I realize money doesn't buy happiness and, at its very best, a minor convenience. Because you dont have clue how to differentiate what's real and whats not!!! For example, every Indian you talk to will always say how religious they are and how a loyal Hindu they were. Well, then ask him whether they will vote for BJP then they become secular.Bull Crap. Make up your mind first, then we can have a conversation. There is nothing wrong to be religious, then quit your job go to India and spend your time in a Temple or something.
