Thanks for your inputs. I noticed in other post that I can apply for EB2 I140 using EB3 labor, is that right? Any ideas?
Any other options?
I know I have to choose between immigration or career, but before making a choice I want to search for all possible options.
As you all know this GC processing is so crazy, most of the rules are kinda gray some unexpected ideas do work. So I want to put some effort in finding other options before going with the obvious ones.

First, I am not your "buddy" and secondly, I was referring to Online Degrees being valid and not to "experience" gained per se. If you can't be nice, try not to write because it will appear by all means that your degree is fraudulent ;)

Based on the instrucionts i am supposed to file at NSC but I don't have more thatn 3months time to apply for AP.
Guys any opinions about me filing for my AP renewal to TSC? If I look at my earlier AP document the one that I filed with my I-485 it has an address of TSC.
Assuming that we get faster apporvals from TSC can I apply for AP renewal at TSC?

My previous employer's lawyer received the RFE on friday, they want me to refile G325 and copy of BirthCertificate. No news on my wife's case.....:(

First thing to do is, hire YOUR attorney and file a fresh G-28. It will cost $1000-1500. Otherwise, your past employer could potentially screw-up your case.
This is good and simple RFE. Nothing to worry. Just do as told in the RFE. Get a copy of the RFE from the lawyer of your past employer and send a reply using your attorney.

Hi Gurus,
Please help me on my case. I am getting conflicting answers regarding my case details.
My priority date is January 16, 2006. I am part of EB3 Phils. I am one of those July 2007 files. I filed my i485 application on July 2, 2007 with an approved i-140 (approved on August 2006).
The thing that complicated my situation is that I had to switch to another job less than 180 days after filing for i1485. I joined a new employer on October 2007. My sponsoring employer however told me that they will not revoke or cancel my i140 given that the company I went to is one of their clients. Until now (April 18, 2008), my i485 is still pending and my i140 is still in approved status. I switched to a new employer using H1B transfer rather than using the approved EAD so that I can stay in a non-immigrant status.
Given that my priority date will be current this coming May 2008, what implications will I have regarding my case given that I have switched to a new employer less than 180 days after filing for my i485 case. By the way, I didn't bother invoking the AC21 clause of informing USCIS that I have switched employers given that I plan to be with them (my sponsoring employer) once my i485 gets approved.
Any insights?

The law specifically states that AC-21 kicks in 180 days since I485 is FILED. You can not change jobs before that and count on approval. Now, they are 2 options here. If the USCIS sends a query for a new employment offer letter, you are in trouble. At that time they will figure out you changed jobs before 180 days. The second option is that the USCIS does not send a query and then you I-485 can get approved. However, this is not legally permissible and they can figure out something was wrong when you apply for citizenship. The fact that your company did not cancel you I140 has NOTHING to do with it. Even if your company cancels 140 after 180days since I140 was filed, you are still entitled to your PD established on I140 stage. However, the 180 days after I485 is filed is hard written law and one should be Very careful when changing jobs.
Also, the fact that you changed using H1 does not make any difference.

Yes, you can call the number below and request for a correction or alternatively you can have your lawyer do the same and follow-up with a written request. I am not sure how long this will take, I hope some one who has already gotten their dates corrected would shed some light on this matter.

As per USCIS , I have to take an Infopass to get this issue sorted out. But I cannot take an infopass because my case is not outside the 60 days processing time!

:) Nothing is guaranteed when you apply for a visa. There can be many things which are beyond your control. But yes, I agree you are in a better situation.
Another option (just to confuse you more).
Technically it is possible that your wife alone can go for H4 stamping, you enter using AP, your wife enter using H4, and you continue working in H1 maintain H1 status and your wife maintain H4 status.
.. mine is an extension, I had successful stamping last time, I am still working for the same employer. Will there be another round of background check ??:eek:

Once youre on EAD and there is problem with I485 ....and you have to fight it out. Can you go back to H1 if you have time left on h1? and continue to work for your current employer at that time.

One more thing is I got finger printing notice in Aug 30th with FP scheduled for Sep 23rd. And I got the CRIS email and status updated on Sep 15th. If the status update corresponds to FP, USCIS server is 15 days slow in generating this email. If it is a private business ... USCIS would be bankrupt long ago...
