I have been to EAD renewal thread few times but didn't see anyone waiting this long , most of the people get EAD approval within a week once they follow up with senators/congressman after 90 days, but in my case its been exceptionally long time of more than 110 days & still counting.

I assume that the sticky post at the top of this very forum titled 'FBI Name Check Victims - Sign Up Here' indicates that there is a community of people stuck in name check on this forum.
It appears you take issue with the fact that my I-485 application is through marriage to a US citizen. But my situation is exactly the same as others stuck in FBI name check hell.
I have read through the threads linked to by others here, thanks everyone for helping out. But I still don't have a good answer to my question. What is the efficacy of writing your congressperson / senator? Based on responses and on other research so far it appears to be of no help for an individual case.
Anyone have stories of success?
I'm considering filing a writ of mandamus, as this whole thing is ridiculous. I am also committed to helping legislators understand the pain that this causes those of us in this situation. The link to American Families United was very much appreciated on this front - I'm going to head over there and sign up. I'm still going to check back here every couple of days too, as there are a lot of you who are very deeply immersed in this and you have a lot of valuable knowledge to share. I appreciate your time helping me.

As to the efficacy of writing to your Representative and Senator, it is just one of the ways of showing that you have exhausted all administrative channels before filing a WOM. In some people's experience that I read about, the said Rep or Senator were not able to do much in facilitating their name check, but exhausting that avenue strengthens their WOM case.

You need a very good attorney who can help introduce a Private bill. A private bill is introduced to grant LPR status to an individual based on extreme humanaterian ground.

Hi,
I recently graduated from a MBA program and have found a job with a top Management consulting firm, very interested in it. But, my I-485 is still pending, nearly 3 years now(I-140 approved). Not sure what my options are, would like to use EAD/AC21, but jobs are different (am a business systems analyst in my current role).
I will also be speaking with my immigration lawyer, but would appreciate your response/advice.

AC21 Same and Similar rules are still very unfriendly; and if your LC does not match with your prospective job, using AC21 is not a good idea (unless your lawyer can find a way)

If its Incorrect fee, I guess in the Returned Application (I485) you might see on how to correct the Application and return it to the Agency . But try searching in this forum or Mathew's Oh site on how to refile in these cases.There is a way of doing it.read it somewhere..

As the ever logical LogicLife said, I think we need to start behaving as 'highly skilled'.
There is too much negativity going on in the forum off-late.
Also please use some common sense and behave like a "highly skilled" group we purport to be.
Some backlog center victims who posted messages rejoicing the Unavailable bulletin think that immigration benefits are a zero sum game.
This is the "zero sum game" mentality where very often people believe that one man's loss is another man's benefit. Its true in case of finite physical resources (like gold, where there is finite amount on planet earth and it cannot be created anymore. Or land, which is also finite and mostly in fixed quantity other than volcanic eruptions)
However, greencards are man-made paperwork created in quantities controlled by man (not nature) and therefore one man's loss is not neccesarily another man's gain. So is EAD. And AP. Its friggin paperwork after all and doesnt have to be finite for which one man's loss is neccesary for another man's benefit.
All it takes for more green cards is one kind of paper work (congressional action) to create a million more of them. And how would any backlog center victim directly lose by having another guy in the next cubicle with PD of 2005 get EAD ? How is that a loss for BEC victim ? The green cards are issued based on PD. Regardless of who applies first for 485, approvals are done based on PD.
And even if sometimes the system unfairly rewards late starters first, get used it. That is life. After you get your green cards, there are many many long years of life still to live where there will be unfairness ALL AROUND YOU. And it will have nothing to do with USCIS or even any government. Just plain dumb luck. Life is not FIFO. In fact, nothing in life is FIFO.
There are millions who settle in life a lot faster despite being less capable and eligible. There are millions who earn their first one million dollars a lot sooner than others that are more hardworking and capable.
However, the attitude of "Zero sum game" where people assume that EVERYTHING is in finite quantity and one man's loss is another man's benefit will not take you very far in life after green card. That's because it will prohibit your creativity - a very important quality when trying to be wealthy and successful.
And finally, if you do rejoice at the revisions of July bulletin because that would somehow do justice to you and your other BEC brothers, please rejoice privately, not publicly. Rejoice all you want, if that's what gives you happiness, but send PMs to your BEC friends or do it over the phone. Have a barbeque at your home. Have a conference call and celebrate.

While I do applaud the initiative, calling a congresswoman/congressman's office on this topic is pointless. Lofgren's office is well aware of High Skilled Immigration related issues including wastage of visa numbers.
Organizing a campaign like this, especially with your reasoning that there is nothing wrong in calling your district representative's office, should be done on one's own behest since this is not an official IV campaign. Please join your State Chapter and forward such requests via your chapter leader if you wish to get it endorsed by IV.
Calling someone's office without any valid talking points or suggestions will only annoy the good office and bring a bad reputation to IV in the event people decide to use IV's name.

My I 485 was filed on 07/12/2007 and my I 140 had been approved on 04/01/2008 on EB2. I had used my EAD while joining my current employer, during April 2009. I had filed an Ac21, informing USCIS about my employment change.
Recently I was interviewed by one of the top Fortune 500 company and they are about to offer me a direct employment. However their immegration department is trying to impose a very stringent terms and condition on me. They said that they do not ave any issue in employing me on EAD. But they have a legal rule of not taking responsibility for any GC application that was not originally applied by them. This means that they will not provide me a AC21 support letter and also I should not use their appointment letter to file AC21. They tell me this is not absolutely necessary to file Ac21. However they tell me that if USCIS is asking me about my employment status during GC approval, they would be able to provide me an employment verification letter.
Under this case Iam kind of uncertain on what needs to be done. The offer I am getteing is really lucrative but I also do not want to take a step that can geoperdize my GC after waiting for 5 long years for it.
I would appreciate if you can kindly provide me your opinion on this.

Let us see how many are willing to contribute after filing 485. Even then people will say they are short of funds even $100 because they have filed 485 and spent everything on attorney. All these days they were cribbing that nothing have been achieved, now they will say that it is not because of IV. Some will say, now filing 485 is not enough for me, I have to get EAD and use AC21 portability so that I could earn more and then I will THINK to contribute. If they use AC21 then they will say, I want my spouse to work on EAD so that I will be financially sound to contribute to IV and it goes on and they will never contribute for ever.
Did anybody think of giving a treat to the CORE team?( I am not exactly sure how many are almost full time working employees of IV, without getting paid).

That's a great input - so did you really give them any letter from new EMPLOYER ( whom you ported with AC21) which said that your future Job will pay you 150K/160K instead of 75K stated in LC

Although I've been working with same employer, my wage has increased substantially due to my skill demand . I submitted pay stubs and W2s for $160k/year, no questions were asked and my 485 was approved.
My understating is that USICS officers do not care about higher wags, but they do question substantial lower wages than LCA.

At least in our case, they told us that everything is ok (name check, biometric, etc.) and the IO had no idea why there was a delay in approving it. So she herself put in a service request.
I think if you call the customer service # and if you can escalate your call to the next level, then they will be able to tell you what the exact status of the case is.
Can they tell us in infopass the exact status of the case? Is there any other way of finding out?

U can raise funds for ur biz from VC investments, the total investment must be 1 million or 500k for rural areas. U must also employ at least 10 US workers, and actively run the business.

I used UPS and sent package to Dalls, TX as per new Direct filing instructions., and since I was using private courier.
When I check tracking its giving me info like ' OUT FOR DELIVERY MESQUITE, TX'
it was sitting in Dallas, then routed to KY and now in Mesquite.
Does anyone know what is going on, why Mesquite?
