Your question itself is your answer.
You said you are going to work with the client through employer by ditching vendor, in otherwords you and your employer cheating this vendor.
May be vendor got this sense before the hand and holding all the money.
Since you mentioned, vendor was paying you on time before and now he is not paying means there is a reason for him to do.
And legally you can not take any action if your employer palce you at the client. Moreover you and your employer will be sued by the vendor.
I think you misread his original post. He mentioned that "since the vendor is not paying the employer, they are planning to skip the vendor and go directly to the client"
Even if that is cheating, vendor has no right to hold the money legally. IF he finds any misconduct in that, he can file a lawsuit, but with holding money is not the way.
Disclaimer: I am not a lawyer and this is not a legal advice.

Had a talk with the HR of the new company. They are willing to support my GC case and agreed to take tab of all expenses related to it - their law firm will handle my case. I am planning to have a tele-conf with their lawyer before taking a decision.
I am currently on H1B... will a H1B transfer be better in this case instead of using EAD?

I think people can sense the sincrerity of a person very accurately. Call him weak or strong, you cannot doubt Manmohan Singh's sincerity. The same cannot be said of Advani. Advani smacks of opportunism. I was aghast when he went to Pakistan and certified Jinnah as a secularist! What was he smoking? Did he really believe that the road to Indian Muslim's votes goes through Pakistan?
Vajpayee was different. He sounded sincere like Manmohan. That is why he succeeded in getting to be PM.

I am still a little bit confused. So because we are/have filed under the old fee structure, to begin with we are charged the old fee for EAD/AP. But for renewal (which is year from now ? is it ?) we will have to pay the new fees.
----------
For AOS applications filed prior to July 30, 2007, filing fees for EAD and AP renewals will continue to be collected at the new rate of $340 and $305 respectively.
----------
Is this done annually ?

Important;
On your I94 you will get the exp date = Passport exp date + 6 months.
example: If you have your passport valid for the next six months when entering US you will be getting I94 Validitity for only 1 yr and you need to get new I94 before it expires.(which means go out of US and come back for a new I94) If you dont stay befond the exp date on I94 - you are illegally staying beyond exp date....

Something tells me that NSC might be working on 485 cases like TSC with an exception of sending or updating the approval notices as and when they are completed.
Maybe they will send all the approval notices this weekend for the cases being worked on till now.
After seeing the Immigrationwatch on the number of approvals and cases touched at NSC(not sure how reliable this is)but , this might be the case.
Also, if you see the history of NSC on approval notices sent , this might make sense. Example did anyone observed this trend in EAD approvals from NSC? My Approval notice for EAD says that the Case is approved on 12/11/07, however the Card expiration date was valid from 12/05/2007 to 12/04/2008. A gap of 8 days between date sent and actual approval
Just being positive....Thats all...Hopefully True
Well..its not like there are absolutely no Approvals from NSC...there are one off cases and notices sent. How would they have gone thru??

Thank you, Kishdam for your very clear answer.
I now understand that an amendment is required if I choose to be on H1.
The company is okay with my moving to NY, but it will not pay for the amendment. According to the company, I have to use the company attorney who is charging $1700 (dont know if this has gone up because of the recent H1 filing fee changes) for filing the amendment. That was why I was checking to see if I can avoid filing an amendment.
You guys have answered if it is possible and/or okay to use AC21 with H1, the answer to which I understand is 'Yes'.
But I guess my question was about why anyone would anyone want to use AC21 with H1 if they have to file amendment (this was my original question in the thread).
In reality, it seems like:
1. If you want to use EAD, you can and will have to use AC21
2. If you want to stay on your H1, you need to amend H1. AC21 is meaningless here even though you can use it.

My friend works for IBM, he has been given two choices (a) take a pink slip or (b) goto India and keep the same job w/ good perks. Given the economic situation, he opted for (b).
This is sad. What happens to the greencard application? All those years of wait is going waste.

In another thread, I posted that CS rep told me my wife can continue to work if EAD is not renewed but application is pending. My lawyer told me she needs to quit.
I went to local USCIS office and I was told
"If your company is OK with it, go ahead and keep working. We will NOT come after you. Each regional director feels different about this issue. Here, (Saint Louis), the director feels people should be able to work if application is pending"
I asked "Will it any way effect the green card?"
She said "No. Like I said, we will not come looking for you"

I don't believe this is happening... What a melodrama! High time someone explains this
Cool down. It's nothing unusual. Read my previous post.
There's no drama and July filers still don't have any hopes.

There is no law in AC21 that talks about hostile environment. As long there was intent to work at the time and during 180 days after I-485 was filed and the person did not move before 180 days , then as of today there is nothing that should prevent the person's AOS to be denied based on hostile environment. Please show me the law where it states that based on hostile environment even if a person leaves after 180 days then his/her AOS can be denied.
That really is scary, however i changed my employer 1.5 years after applying for 485 in june 2007. Also after i had sent out the AC21 paperwork there was a soft LUD on my 140.

Since your husband's I140 was approved and I485 was pending before he left, did you file a derivative I485 for yourself as well? Also, does he have a valid AP now?
GC is for future employment and there is no requirement to be working for the GC sponsoring employer at any time during the GC process. At the time of 485 approval however it becomes necessary to be working for the GC employer or (under AC21) work in a similar job / have a similar job offer from same or different employer which can prove the employer's intent to hire the person after getting the green card. This is necessary in case USCIS issues a RFE / NOID.
