despite all comments here, i suggest you do it. remember that only those people who faced problems would come to this forum to talk about it... for every one person who faced problems there might be 10s if not 100s who went through it alright. i have changed employers on ac21, my new employer's lawyer sent USCIS a letter without my authorization that my new employer will take responsibility of my 140... uscis obviously confused, sent me an RFE asking for the evl again while acknowledging that my lawyer's earlier letter did not address all AC21 requirements (they spelled that out). I responded with the help of my new employer and all is well. no rejections, no NOID no nothing... all safe and all well... i am considering from a long time and now currently seeking to move to self-employment using ac21... i dont see major risks...

I am in a dilemma because my PD is EB2 India Feb 02, 2005. It seems to be very close to being current right now :o .. My I140 was approved in Nov 2007 and I485 was filed in Aug 2007. I think that my current employer might revoke the I140 if I decide to leave.

Completed means "Data Entry Completed". They have a long way to go. In year and half since BECs started functioning they have done data entry only for about 33% of cases. How the hell they will do 100% data entry by JUne 2006 which DOL claims they will do. We are gonna rot there for a long time.
Filing for 1-140/485 don't even come to my mind.
I haven't verfied this but I took "Completed" to mean that a decision has been rendered.

Hello All,
My wife and I got married recently in september few days after my labor was approved.We were going to get married in 2007 but my lawyers recommended getting married before filing GC applications together. She is one of retrogession victims in EB3-World. I am in the EB2-World queue and my company is planning to apply for both I140 and I485 concurrently in the following week(s). However my wife and I have been living in different states for over a year now and she thinks we might have an issue because of that. I was wondering if anybody in the similar situation had any issues.

No immig. docs. for medical.
Only one or two photo IDs. Preferably, passports an DLs. I think they enter PP # on I-693. That is what link's you ( or is it SSN or ITIN).
Note: Remember to put ITIN (IRS issued Income Tax Identification Number), on dependent's SSN field.
For me they took my SSN in the sign in form, though they glanced at my DL never even took my DL info. Guess, just name suffices.

As per USCIS memo issued some time ago, one should inform USCIS of change in employment at the I485 stage. So, it is safest to get a letter of employment (permanent) with duties that match closely PERM and send it to USCIS when you change employers.

I may end up in the same boat as you after spending 12 years in this mess. I am thinking that if your previous employer is OK you can file 140 under EB2 while working for your current employer.
I could be wrong but I don't think there is a requirement to work for the sponsoring company while filing I-140 or I485. As long as your previous employer has the intention to hire you(by providing the offer letter) once GC is approved you should be fine.
GC is for future employment.
IMO this is the best route. If your previous company is fine with this ask them to process I-140 also. Once your GC is approved, you can work for your old employer for an year or so. That way you won't be violating intent to work for the future employer also not leaving your present employer.

USCIS will verify everything again at the end of 2 1/2 years and issue a permanent green card. so, the whole process can take upto 4 years of time. this is plain information. get full masala from any immigration lawyer.

I got my approval with the help of Ombudsman office. But, I have not received the card in hand. I received a letter from USCIS and an e-mail from Ombudsman office, about confirming that my case is approved with validity start and end dates.
The USCIS letter asks me to wait for 30 days for the card production and receive it.
I suggest you try with the Ombudsman office, they are very good in responding and helping.

There is no formal procedure like "invoke AC21" and it is not required that we have to inform CIS about employer/job change. But once we change employer after 180 days we are automatically using AC21 rule. Correct me if I am wrong.

My EAD expired on Sep 3rd and I am on an unpaid leave of absense since then.
Recieved Date: July 28, 2010
Notice Date: Aug 05, 2010
Expiry Date: Sep 3, 2010
It's been over 70 days since the recieved date, SR with NSC got rejected asking us to wait for 90 days. Tried faxing a letter to the Senator(Barbara Boxer) and haven't heard from them.
I am at the risk of losing my job, please help!

I lost my job recently with the company sponsoring my H1B and GC. I have EAD and AP (July 2nd Filer) and it has been > 180 days. I was on 7th year H1B at this time.
My question is: My company is probably going to inform CIS about my termination of employment soon. Will I get a RFE from CIS asking about my employment situation once my company informs CIS? What will the RFE most likely request?
Also, my company's attorney is advising me that the new employer should send a "Notice of I-140 Portability"? How important is that? I am not sure if my old employer will revoke my approved I-140. But will I be in trouble if they do so before a new employer sends "Notice of I-140 Portability"?

thanks again guys. so is it ok for me to find another job inthe same field and move on - if i can find one quickly. so a move does not affect my future citizenship application ? is that a fair statement. or does it all boil down to luck at the end. some people say u can leave the company in less than 6 months and some say it is not ok. is there some kind of law governing this - can some one pointme to it. i have waited for 10 years to get my GC and would hate to put it in jeopardy. i guess dignity does not hold when it comes to the point of GC revocation. god - this sucks. do i have to please the company, my boss, my self or the uscis. it sucks to know that u put ur mind and soul into the job and at the end this is how they pay off loyalty. anyways no complaints,. wondering how i can get out of this situation without jeopardizing my green card. any sugegstions and pointers. i can really use some now.

Dude.....chill. Take it easy and go on vacation for sometime. You need a break. Start looking for a job. In this economy it might take around 6 weeks on an average to get a new offer. By that time you will be beyond the 6 months period. Good luck.

I just called speaker's office again on phone# 202-225-4965 , and requested a lady on the phone, to pass on a message to Speaker to consider HR 5882 for voting in 110 th congress.
